NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #11

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to continue for 2 weeks although at the start of the second week getting everything done in this time period was looking less certain. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on Thursday 6 February.

I am finding the fact that the judge is allowing Dr Upton to try to police NC's language particularly frustrating. Why is he allowing him to tell everyone what words they must use!!!

NC - a rape survivor ought to be able to insist on seeing a woman not a transwoman?

BU - 'actual woman' is not useful, means 'cis woman' - I consider both to be women. Any person of any GI can experience sexual violence, or perpetrate. Anybody who is the victim of SA should have concerns and distress be taken into consideration as far as possible within limits of emergency care

What if it was a MUSLIM woman??

DU: I think any person or any gender identity can experience sexual violence.. can perpetrate sexual violence. Anyone who has been a victim of sexual violence should have their concerns addressed.

But he just said he won't disclose he's male. So much waffle to try and conceal the abuse.

NC asked the judge to reign in JRs interruptions and DUs long rambling answers but the judge refused in a very tetchy manner

NC - in order to have a wish to see a female doc honuored, a female patient may reasonably be expected to disclose SA in hisotyr, make a special case?

BU -no, any patient may refuse to see a doc for any reason. Primary concenr is providing medical care. If collg is black and patient doesn't want to see her, we prioritise patient. we deal with emergencies predominantyl, as much as poss we accomodate preferences, they don't have to disclose reason for prefs

Initially I found the poor song quality irritating, but actually it gives blessed relief from the lady-voice.
