NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #11

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to continue for 2 weeks although at the start of the second week getting everything done in this time period was looking less certain. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on Thursday 6 February.

JR - going back to docs where previous judge addressed that and said the tribunal does not find that it's obvious that Dr U is male and appears male.

Absolutely agree. If NHS Fife & Dr Upton lose this case then there is a serious question about whether he lied in his complaints about patient care by SP and lied in court. Lying in court should result in him being struck off.

The patient care issue is the smoking gun. When was it added, by who and on what grounds? Definitely feels like an afterthought to justify the earlier suspension.

Finally caught up! I've managed to dial in today, but I'm not sure how long I'm going to be able to stick it out. I'm finding both JR's and BU delivery irritating, let alone the content of what they're saying.

NC - not reasonable to conduct a hearing on the basis that I'm not permitted to ask any question of which JR doesn't immediately see immediate relevance. I must be allowed to ask a series of questions with a point at the end, that's how X examination works. Barely 10 minutes in, at least 5 taken up with JR's objectiosn, which were constant yesterday. Yesterday, JR made a large # of objections to my qus, every time, not going to disallow. Perfectly proper approach for jduge to take, but it ought by now given indication to Ms R that constant interventions not helpful.

NC stopped intervening and allowed JR to do her job as she saw fit. Asking judge to instruct JR to do the same.

Judge - not going to do that. I did uphold the 1984 point and that didn't contine. Not appropriate - both sides are enttitled to object. I may say something about it if irrelevant. Appreciate what you say about questions not being obvious til end of sequence, allowing question at this point.
