NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #11

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to continue for 2 weeks although at the start of the second week getting everything done in this time period was looking less certain. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on Thursday 6 February.

BU - I don t need you to use my pronouns to validate me. People do consider me a woman. It makes me upset, distressed and hurt when people don't respect me or I feel people are being rude about me/ I don't need yr validation, I'd like yr respect.

Respect v validation. Is there much of a distinction.

NC - your legal team sought direction from tribunal that SP and legal should be required to pay lipservice to your belief

JR - what I did say was that NC should comply with Equal Treatment Bench book and prof codes, which advise us to respect pronouns of people in court

I keep trying to catch up to the end of the thread to write a comment, but am failing, so I'll just write one anyway.

I'm a long term lurker on these boards and want to say a big thank you to all of you.

I had a hospital procedure yesterday (nothing related to my female anatomy). There were men and women in the room, but if a Dr like this would have come in, it probably would have sent me into a panic attack, because I wouldn't have felt able to say I'm not comfortable.

So much admiration for all the brilliant women standing up to this and bringing it to light!
