NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #11

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to continue for 2 weeks although at the start of the second week getting everything done in this time period was looking less certain. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on Thursday 6 February.

Bu - it was common fro me to experience minor rudeness from SP, so when I experienced direct rudeness I noted it because it felt notable

NC - was this more extreme than other minor rudenesses?

BU - yes, because it involved a patient I had responsibility for

NC - it is clear you'd been recording SP since August

BU - I'd been documenting instances where I felt hostility from collgs, yes

but if it's one of many ismilar, why don't we see more of the others?

BU - We don't work togehter frequently, i dont record every slight against me, it had been an escalating for a period of time, if we all spent time recording everything we thought rude we'd have no time to do anything

One thing I can’t get my head around is that the reference to appearance is how the doctor looks now not when the events took place - which was sometime ago.

There is literally nothing more minor than someone talking to someone else in the room rather than directly to you. It is not possible there were more minor incidents DU didn't record (as he just said) because that is so incredibly minor.

So the ones he has documented are THE MOST SERIOUS. This is a very good point I think. If he’s accusing her of patient safety issues, these are the worst things he’s seen her do. i.e. not being nice to him.

NC - you are at best overinterpteting a v trivial incient, because you'r ehostile to her, because she's refusing to undress in CR

BU - no. Not hostile at all. Don't think she should be forced to undress in CR. I'm upset, I have no hostile ill will. Unfortuantely her behaviour is deeply unpleasant and inappropriate, that's the limit of my feeling, I haven't been making things up.

Of course not. A senior nursing colleague and I once hurled abuse at each other in the coffee room and no more was ever said about it because sometimes people don't get on and that's life.
