NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #9

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on Thursday 6 February.

"Who ignored SP and why?"

I might have this mixed up but was there some mention early on that her 1st approach to her line manager to raise the issue involved that person seeking advice or clarity, and possibly the EDI 'person' getting involved/feeding into whatever the trust's adopted position was? What happened, who made the decision, how that was reached etc. hasn't been clear so far from what I've heard/read, but I've not been able to keep up as much so might have missed that.

The key is absolutely how the trust dealt with her 1st raising the issue & who was involved in that process. The fact they left her dangling, with no response or advice on the concerns she raised, is a massive fail.

Obviously, employing a TRA doctor keen to expose transphobes & with a huge sense of entitlement, was another fail.

I have really struggled to listen to him today. The lies, compounded with smugness, told in a way that it is almost impossible to prove that they're lies, the refusal to actually answer any of the questions, the refusal to empathise with women and insisting that he can't possibly infer what other people's preferences/feelings might be whilst repeatedly accusing SP of hostility when all she did was leave the room without saying a word, the recruiting of others, making sure that they were on his side before he escalated things.

I grew up with a violent, coercively controlling father, and this is how he used to operate.

Surely only a rogue/failing NHS trust would employ doctors who don't know what sex people are and why knowing this is important?

I am sure he knows exactly what sex the people are in front of him. He won't lose his job over that.

It is only essential that they do not know, or can no longer articulate, what sex he is. So that he can do what he wants.

I wish no one would say biological in this context tbh. It just gives credence to the idea that there is any other kind of man and woman, any other meaning to male and female. Unfortunately however the GRA and concept of 'legal sex' has landed us in this mess.

I am not a legal, can someone please reassure me that NC will pull this back, it doesn't feel to me like this going well... Why is she not challenging DR U more?

She is putting things in place slowly, brick by brick.

She knows what she is doing and where she will end up. It may not all make immediate sense today, but she still has the Employer side to question yet etc.
I think it is going ok so far for SP.

It will all come together eventually in a final submission.

It doesn't seem unlikely to me that the two of them could genuinely have different memories of this occasion; I wouldn't like to put money on whose memory was correct. I hope SP's memory is correct.
