Morning,

is anyone keeping an eye on the Fife nurse employment tribunal case? Tribunal Tweets will report from the court room but I’ll be at work today and was wondering if people could gather the most salient points here?

The case has previously been discussed on MN here:

I myself have a similar case going through the ET court now, to protect single sex facilities at work, hence the interest:

NHS Fife tries to silence nurse | Mumsnet

So as has been mentioned on threads about the Darlington nurses a nurse is sueing NHS Fife over its trans staff policy. The poor nurse was forced to...

Our local swimming pool is all mixed changing in cubicles. Now all the cubicles have bars over the top to stop people climbing from one cubicle into another. They still sometimes hold phones over though, and film the next door cubicle. Some men are just vile. Separate sex changing is the only real answer, with third spaces if that’s deemed necessary

Anyway, any update from today’s proceedings welcome…

If you believe TWAW then theres no need to mess about building individual cubicles, thats the view of this NHS trust it seems.

And I'd like to bet that none of the "people" climbing over, or holding phones to film into other cubicles, are female.

Yep, that would be my understanding!

One of the most illuminating parts was when the KC for Dr Upton (the man in the women’s changing room) asked Sandie Peggie (the nurse) whether she makes a distinction between biological women and non-biological women.

The world has officially gone mad.

The BBC write up is ok if your you’re looking for something to get the gist of things

There’s this thread too www.mumsnet.com/talk/womens_rights/5186317-nhs-fife-tries-to-silence-nurse?page=29

Single sex changing rooms wouldn't help with the fact that people like Dr Upton (no opinion on Dr Upton one way or the other of course) ENJOY imposing themselves on women (real ones) in women's changing rooms.

How awful that Dr Upton's feelings were hurt, when Ms Peggy's dignity and safety was put at risk?

How awful that Dr Upton asserted Dr Upton's right to be there when questioned. If Dr Upton was really a woman, Dr Upton would have been statistically much more likely to have been concerned about the impact of Dr Upton's presence on other people too.

Runor · 04/02/2025 06:41

VelvetThrows, in this case, I think single-sex changing rooms would have helped - if only that it would have been Dr Upton spending so much time suspended, Ms Peggie would have been allowed to work and otherwise (correctly) treated as the victim here.

Otherwise YES, your points about women’s typical behaviour versus Dr Upton is absolutely spot on

The Fife case is in Scotland which is a different jurisdiction to English Employment Tribunals. My case might still end up being the first one in England, depending on court dates.

I'm still in need of some turnips at the allotment site, please search Faye Russell-Caldicott at CrowdJustice.com, MN doesn't allow links. Sharing would be hugely appreciated even if you can't support this time. I've got a prel hearing in Feb so need to cover costs of that very soon.

Faye, I wonder if you can explain how the anonymity you are seeking in February would work, given your name is already associated with the case through crowdfunding?
Obv, IANAL! Thankyou

Brefugee · 04/02/2025 10:24

I'm worried "we're" going to lose this one 😢
