Live case on non-binary gender

Don't think I've seen this one discussed here: going on right now. If I understand correctly on a brief read, someone claiming they should be able to have a GRA stating that they are non-binary, because they have some document from California that says they are non-binary (and California is trusted in some sense). Going on right now in the Court of Appeal: Castellucci (claimant/appellant) v Gender Recognition Panel (defendant/respondent)

"Tuesday 21 January 2025 Before the President of the King's Bench Division the President of the Family Division Lord Justice Singh By Appellant’s Notice filed on the 4 March 2024, this is an appeal against the order of the Administrative Court dated 17 January 2024. The Appellant sought to challenge the decision of the Respondent not to issue a gender recognition certificate (GRC) which states their gender as ‘non-binary’. The judicial review claim was dismissed by the Divisional Court which found that references in the Gender Recognition Act to ‘gender’ were to a binary concept (the male or female gender), so that the GRP had no power to issue a GRC in the terms sought. The Court also rejected the contention that the GRP’s decision involved unjustifiable discrimination in comparison with a person whose acquired gender was male or female, contrary to Article 14 ECHR and section 6(1) of the HRA.

because they have some document from California that says they are non-binary

Since when would the UK accept non-national documents? Does he have a USA document?

The timing is a bit unfortunate for the appellant here in that there's just been an executive order saying that any USA document that says he's non-binary will be withdrawn. So the USA itself would not actually uphold his Californian non-binary ID any longer.

Ereshkigalangcleg · 21/01/2025 13:29

I think there is a thread for the first unsuccessful hearing.

zanahoria · 21/01/2025 13:36

Well lucky old them

Just tell them that they are more free to tell anyone who is interested that they are non binary, a two spirited demi boi or whatever but unfortunately the law in this country does not give a shite.

And another A male 'non binary' person gains a female GRC. www.mumsnet.com/Talk/womens_rights/5108465-a-male-non-binary-person-gains-a-female-grc

Ereshkigalangcleg · 21/01/2025 13:43

There is an overseas route for recognition under the GRA i.e. if you have transitioned in a country that has a system recognised as equivalent in our legislation then that gives you a quick route to recognition here. It's written directly into the legislation and always has been. See s1 (1)(b) here https://www.legislation.gov.uk/ukpga/2004/7/section/1

Details here https://www.gov.uk/government/publications/gender-recognition-certificate-list-of-approved-countries-and-territories/gender-recognition-certificate-list-of-approved-countries-and-territories

The list was changed recently and I can't remember the details but possibly this case was a catalyst.

Was that the route Freddy McConnell was hoping to use to be registered as the father rather than the mother on the birth certificate?

Trans man hoping to fly to Sweden to give birth to second baby

Freddy McConnell wants to go to Sweden for the birth so that he can be legally recognised on the birth certificate as the baby's father

This is from his Crowdfunder

I've already incurred tens of thousands of pounds in costs to bring this case to trial, and we expect tens of thousands more. We've set the funding goal to £100,000 to ensure the actual expenses can be fully covered. The money will go to Leigh Day to cover their fees for this case, including costs incurred to date, and also potentially to protect me from adverse costs if costs are awarded against me. Unused funds will be reserved for any appeals, or, should we win without the government appealing, handled in accordance with CrowdJustice's terms.

He had just under £90k raised so far.

Do you think law firms may take these cases as a tax write-off? If they can, it would be a win/lose but still win situation for them.

Ereshkigalangcleg · 22/01/2025 18:27

What a waste of time and money this vanity case is.

Ereshkigalangcleg · 22/01/2025 18:28

And I don't mean he definitely won't win, it's just such a self indulgent pile of wank whatever the outcome.

Ereshkigalangcleg · 09/07/2025 13:02

Good. Stop wasting everyone’s time.

Lins77 · 09/07/2025 13:21

Some people really don't have enough to do with their time! What a load of egotistical nonsense.

Exactly, someone who has gone to the expense of retaining a penis while having a neo vagina squeezed in like an ensuite bathroom in a tiny house is not trying to re shape the worlds view of what gender is, they are a narcissist of the highest order, and as someone who works in IT he would probably have been wiser to save his money and see how he could have had his entire genital area permanently pixilated .

Ereshkigalangcleg · 09/07/2025 19:54

“Like an en-suite bathroom in a tiny house” 🤣 🍷

ArabellaScott · 09/07/2025 20:03

Well, good.

I'm sure he'll be back, having had half his skeleton removed and declared himself non-bonary.

Ereshkigalangcleg · 09/07/2025 20:05

🤣 the jokes write themselves

Rightsraptor · 09/07/2025 20:39

Am I the only person who thinks it a bloody cheek to go to a foreign country and try to change their laws?

Plenty of countries would give Ryan extremely short shrift if he tried to do it in their county.

If you don't like it here Ryan - bugger off back to California.

GallantKumquat · 10/07/2025 03:06

“Like an en-suite bathroom in a tiny house” 🤣😂😅😳 Also, RIP my dreams of bourgeois gentility. I'll have to settle for candle light suppers. 😠
