US Supreme Court thread - United States v Skrmetti December 4th

Big case on Wednesday. In theory it might be a big win for reality, but we can't underestimate the power of the idea of gender stereotypes have in the US and the money involved from the gender industry.

Decent Economist article covers the implications:

A big transgender-rights case heads to America’s Supreme Court
The justices take on paediatric gender medicine
A case to be heard by the Supreme Court on December 4th is set to reignite debate about one of the election’s most controversial issues: the rights of transgender people, and specifically the medical transitioning of minors. In 2023, Tennessee enacted Senate Bill 1 (SB1), which bans puberty blockers, cross-sex hormones and surgery for minors who identify as trans. It is one of 26 states that have done so. Now, in United States v Skrmetti, the federal government, supported by the American Civil Liberties Union (ACLU), is suing Tennessee on behalf of the parents of three teenagers, claiming the ban violates the equal-protection clause of the constitution’s 14th Amendment.

The deeper story behind the case.

WoLF Files to SCOTUS in US v. Skrmetti to Protect Children from “Gender” Medicine
Today, WoLF filed an amicus brief to the U.S. Supreme Court in U.S. v. Skrmetti, defending laws that ban the use of puberty blockers, cross-sex hormones, and genital surgeries on minors for so-called “gender affirmation.”

WoLF argues that these procedures not only cause permanent harm, but also stem from an ideological movement that seeks to erase biological reality to the detriment of society’s most vulnerable—children, women, and LGB individuals. As this case heads to the Nation’s highest court, the stakes for children’s futures have never been higher.

Who’s Who in US v. Skrmetti
Drugged kids, a tacky gynecologist, and Miss Idaho
American lawsuits aren’t about ideas. They’re about people.
You might think Skrmetti, the case that’s scheduled for oral argument before the Supreme Court on Wednesday, is about discrimination or pediatric gender medicine (PGM). But it’s actually about three kids who want to be the opposite sex, their eager moms, and a gynecologist whose YouTube channel is called Crotch Talk.
These plaintiffs are represented by the voluble trans activist Chase Strangio, who has joined forces with her friend Elizabeth Prelogar, the US Solicitor General, to battle the Attorney General of Tennessee, Jonathan Skrmetti, over whether his state’s ban on PGM violates the US Constitution.

On the American Academy of Pediatrics' Faulty Brief to the Supreme Court About Gender-Care Bans
My breakdown of the amicus, or "friend-of-the-court", brief that the AAP and a roster of other medical societies submitted to the high court, which is riddled with flaws and remarkable omissions.

Wow. I didn't realise that Chase Strangio was so pro-censorship.

NecessaryScene · 03/12/2024 12:43

I'm not convinced Strangio is aware what the ACLU is, beyond being just some sort of legal lobby group. Everything I've seen related to Strangio suggests it's just being used as a tool for "trans" activism, whether that be getting drugs to children, suppressing books, or eliminating women's sport - or women's anything, tbh..

None of which seems to me to be obviously something the ACLU should be fighting for.

lcakethereforeIam · 03/12/2024 14:06

Strangio transitioned as an adult, somehow surviving not having gender affirming 'care' as a child. In Chase's own words

“I am distinctly not a miserable person, and I do not approach this work from a place of being downtrodden.”

I'd argue this makes Strangio a poster child against a need for childhood transition.

Strangio has come with some clangers in the past if I remember rightly.

Strangio is so deluded they might help lose their own case. Pity they won't get to say more than 15 minutes.

Elizabeth Prelogar is way more effective though.

Kara Dansky's book The Reckoning goes into some detail on how the ACLU has been largely repurposed over the past decade or so to fight for the abolition of sex in law. (Dansky used to work for the ACLU.)

A quick glance at mainstream media coverage of case in the US reveals how captured it all is. Little mention of the revelation that this is all a medical scandal that WPATH was lying or implications for women.

Typical example;
https://edition.cnn.com/2024/12/03/us/transgender-health-care-bans-trans/index.html

However the coverup is failing in some places the truth is getting out. e.g article in The Boston Globe

Legal challenges to red-state bans on youth gender care have illuminated a cover-up
Evidence unearthed in a Supreme Court case and other lawsuits doesn’t look good for advocates of these treatments.

How a Supreme Court decision on health care bans for transgender youth could impact trans people nationwide | CNN

When Tennessee banned gender-affirming care for transgender youth last year, Sarah began taking days off work to drive hundreds of miles from her home in Nashville to a North Carolina clinic that could treat her transgender son.

That Boston Globe article by Lisa Selin Davis is the first, the absolute first, I've seen in a large mainstream US news source that mentions the evidence against pediatric use of puberty blockers. The media in the whole country, except for right wingers who are crazy in too many other ways, is completely in the tank for trans activists. This is a breath of fresh air. Maybe there's hope for the US.

GargoylesofBeelzebub · 04/12/2024 08:00

Chase Strangio is very clearly unwell. They couldn't have picked someone to demonstrate better how batshit the adherents to trans ideology are.

I see their appearance on tv saying two year olds should be allowed to transition is all over Twitter peaking people with how ridiculous Chase is.

dunBle · 04/12/2024 08:13

Lisa Selin Davis has been banging on about this for a while, including her frustration at getting mainstream outlets to publish on it.

Thanks for this and the archive.

This stood out “If you can’t go to the bathroom, you can’t go to school or have a job,” he previously said

Yes and that applies to women who need single SEX spaces too, of whom there are a much greater number. Luckily, third spaces for trans identified males would solve everything, right?

Unless of course it's really about accessing unconsenting women....

I think that's the case with a lot of these activists, and the organisations which have been taken over and hollowed out to support them. In the UK as well.

nauticant · 04/12/2024 11:32

Not sure, but the ACLU did a Ministry of Truth on Bader-Ginsberg's words:

nauticant · 04/12/2024 11:32

I wonder how long it'll be before Goldberg is back again, apologising for yet another "ham-handed" "mistake".

How on earth can anyone posthumously impose a belief on someone?!

"However, he surmised that Ginsburg would have supported the sentiment behind making her quote gender-neutral.

“Having spent time with Justice Ginsburg, I would like to believe that if she were alive today, she would encourage us to evolve our language to encompass a broader vision of gender, identity and sexuality,” said Romero."

It's as bonkers as saying "I would like to believe that if she were alive today, she would encourage us to convert from Christianity to Allah, the one true god." Nobody has the right to impose their own beliefs on someone else in such a binding way, as if the belief is morally superior somehow. Especially when that person is no longer alive to agree or disagree to this. FFS.

The irony that this bizarre approach of posthumous retconning will, in future, be an embarrassing anachronism too is quite something to behold. With luck it'll look outdated by next year, as enforced belief in gender identity continues to fall out of fashion.

Also this:
The tattooed and mustached lawyer has a 12-year-old son

Is this another case of someone who has their own biological children who wants to sterilise children?

In this video, Strangio admits that children can't consent to treatment (in this case at 2 years old - what sort of treatment would that be?).

Trans lawyer concedes kids can't consent to sex change procedures while defending practice

Edit: I just watched the video again. Strangio is talking about adolescents not being able to consent, and their parents give consent for the treatment.

Strangio just said the evidence shows that gender transition does not affect suicide rates. Oooppps!

Evidence that Strangio is really a secret terf is mounting.

RedToothBrush · 04/12/2024 17:09

This is unconnected but I think it's a concerning development with a focus on trust in US healthcare.

It's being reported that there has been a targeted fatal hit on the CEO of UnitedHealthcare’s insurance unit, in New York City.

"Every indication that this was a premeditated, preplanned, targeted attack"

These cases just took on another level of significance.
