Asked if he would be fighting to push the bill through, Mr Swinney told Sky News: "The reality of the situation we face is that the Supreme Court has said that we can't legislate in that area. We can't take forward that legislation."

His predecessor Humza Yousaf had previously suggested he wanted to work with the UK Labour Party to amend the laws ahead of the general election.

Which I take to mean he isn't against the GRC just that the UK Government has the upper hand.

I was (still am) more worried the with Labour in power the UK wide laws will be ammended so that the GRC will not be out of line.

John Swinney also says he believes Scottish independence can be delivered in five years thanks to Brexit and the cost of living crisis.

If you read further he's quite clear that the only reason he can't is because the supreme Court refused their judicial review and the UK government won't lift the section 35 but he wants them too

Agreed - I was posting more because all over social media many are posting that this is a great victory for women. And of course I dont under estimate the impact of GC campaigning on the issue.

But what has (for the moment) stopped it is the UK Government taking them to court for not creating a law inline with UK wide law they have to abide by. Which the court confirmed.

Which is why Yusaf had obviulsy thought he could get a Labour (UK) Government to change the UK wide law to accommodate the Scottish GRC.

We are all still in the hands of those who have the power of their political decisions.

This isn't a win for women's sex based rights.

They are still far from acknowledged.

This is just another 'it's Westminster's fault we can't have what we want' exercise in their constant time and money wasting campaign for the Independence fantasy. They give not a single shiny shit about women, our children, our rights, our identities or the danger we are put in. ScotGov hate women as much as they they hate English Government. If they can't attack one, they attack the other.

This is another version of the story, which gives it a slightly different slant. Or maybe that the Scottish Government spokesperson has consulted with the new leader before making a statement:

A spokesperson for the Scottish Government said its position "is simple" and the "UK Government should lift" the Section 35 order.

The spokesperson said: "The GRR Bill was passed by the Scottish Parliament. If the UK Government lifted its legal block, the Section 35 order, it would become law.

"The problem is that the current UK Government has said they will not.

"The Scottish Government's position is simple – the UK Government should lift their Section 35 order.

This does not look good. Since the Scottish greens have gone all in on the gender woo angle the only way swinney can keep them on side, even on a confidence and supply basis, is to dangle the GRR carrot. Adde to which Starmer looks likely to be our next prime minister and I dont trust him any further than I can piss its a bit worrying.

I'm more optimistic, I think some of them, possibly including JS, have finally realised that gender woo is deeply unpopular among real Scottish people and they won't take it any further. The S35 is just convenient as they can hide behind it.
