A non binary trans person has lost his legal case against a famed writer for calling him ‘a man’.

The judge ruled it was reasonable to assume Marcus Ventura was a male based on his appearance.

It's so mad. I'm speechless.
Can judges not just throw cases like this out of court?
I feel like this is probably a bad precedent ...hate crime laws....compelled speech. It isn't really as funny as it seems at first.

There was a thread on that. It was in Barcelona.

It boiled down to a transwoman who has had genital surgery and therefore claims to be a woman saying another transwoman was not a woman because said second TW hadn't had the surgery.

The court ordered an investigation which culminated in a report that, amongst other things, the accused held that view about TW who have not had genital surgery in general.

Would a court case like this happen for an actual woman or man who was upset about being mis-sexed? And could anyone be convicted for it? Because if not surely that’s discrimination on the basis of gender reassignment.

Yes, that’s horrific. Thank god the judge in the latest case made a sane decision. But presumably future cases could still go either way.

These cases are in Spain, which doesn't have the same equality legislation as Britain.

Classic transmisia. (Finally found an example that makes some vague sense of this interesting guide.)

Trans folks can be agents of transmisia as well… by perpetuating the notion of gender binary or "passing" superiority and using it to discriminate against other transgender people. For example, a trans woman at a company may refuse to hire a genderqueer person because their gender presentation might "confuse" customers, or a trans male administrator at a traditionally women's college may deny the application of a non-passing trans woman for not "transitioning enough."
