Haldane judgement appeal

Sorry if there's already a thread that I missed, but I haven't seen one. FWS are appealing the Haldane judgement (the one that put "legal sex" where we'd really expect and want "sex"). I just donated: you might want to too. Can't post the link here but if you Google

If only the government would do the right thing and make an amendment to the EA to say that sex mean biological sex it would save so much time and money. Presumably they're hoping the courts will make the decision for them so that it is judges and not the government that are accused of genocide.

But the exceptions simply cannot work at all if woman is "legal sex" and not biological sex. As Michael Foran and others have pointed out there is no way to limit any service or space to bio women if they are not a protected characteristic in the Equality Act.

The exceptions allow provision of a single-sex service where it is a legitimate aim, where, if sex is legal sex, it means a single-legal-sex service. So a woman-only service under the exceptions must cover, by definition, bio women (except those with a GRC saying they are men) plus bio men with a GRC saying they are women.

And it would also make a nonsense of the the protected characteristic of pregnancy and maternity which would apply to the legally female people (who cannot gestate) but not the legally male people (who can). It's not just the exceptions concerned with sex discrimination, it's this protected characteristic as well. That cannot have been what the original legislators intended, either.

...who pinched all the points made by FWS's KC at the judicial review hearing, despite arguing against them at the time. I wonder if the EHRC will come in the case this time?

Thanks. That was an absolutely crazy judgement. It assumed the law makers at the time could see ahead to this crazy ideology and so their law making can be interpreted through that lens.

Couldn't agree more.

Just donated. Yes I am also sick of having to fund these cases which shouldn't be necessary in the first place. Seems incredible that Lady Haldane has chosen (as a person of her age and sex) to forget that until a few years ago everyone regarded sex and gender as interchangeable words meaning 'biological sex'. The protected characteristics are clearly listed and Stonewall et al (including Keir Starmer) have chosen to wilfully misinterpret them.

I've donated despite being fed up of paying for the bleeding obvious.

The lawyers insistent on telling us that women should not exist legally unless it includes men are....well words fail me, exactly as they have ensured they fail women.

It's all so sexist and of a time that has now passed. My message to those living with an identity, get men to accept what you want to do with your life and leave women alone.
