The results/analysis of the Scottish government's survey are in. Had a quick look and it seems quite good and even states that the most common theme through all the responses was the need for single sex spaces 😃

The most frequent cross-cutting theme concerned the need for single-sex services and female-only staff. Respondents highlighted that single-sex services should be made into law, widely available, clearly advertised and co-exist with non-single-sex options. Responses suggested that single-sex spaces are vital to ensuring victims of VAWG feel safe and protected, otherwise women might self-exclude due to religious or cultural reasons

But isn’t the effect of the Lady Haldane argument that males can be in single sex women’s spaces as long as they have a GRC? So the Scottish government can do a fudgey flourish about how single-sex spaces are fine and doable because TWAW?

No it doesn't but only because rape crisis centres, toilets, changing facilities and other single sex services where a specific need can be proven (with a whole bunch of conditions and caveats involved) were specifically set out as one of the exceptions in the equality act that allows us to discriminate against transwomen with a grc, but only IF the service provider chooses to use it. The ruling states that a biological male with a grc is a woman under the equality act for all circumstances except the specific exceptions stated in the act (yes I know ridiculous and confusingly illogical).

I find this a bit lacking:

It makes it sound like women will only self-exclude because they’ve been taught they won’t feel safe if men are there and their fears are irrational. Whereas the whole reason we have a focus on VAWG is because women are less safe around men.

The survey concluded before the Haldane judgment so it couldn't have been taken into account. Regardless, the judgment of the higher court, which the lower court of Haldane cannot overturn, still stands as settled case law and was accepted by the Scottish Government. It says 'provision for women, by definition excludes biological males'.

The language around VAWG needs to change.

It's male violence. Focus on the perpetrators not the victims.

It's should also be sex based violence not gender based violence.
