Hospital told police patient not raped because attacker transgender

A hospital told the police that a patient could not have been raped because her alleged attacker was trans, the House of Lords has heard.

The attack took place a year ago and the woman reported it but when officers contacted the hospital, which has not been named, they were told “that there was no male in the hospital, therefore the rape could not have happened”.

Baroness Nicholson of Winterbourne, who raised the issue during a debate on single-sex wards, continued: “They forgot that there was CCTV, nurses and observers.

“None the less, it has taken nearly a year for the hospital to agree that there was a male on the ward and, yes, this rape happened.

“The result of Annex B is that hospital trusts inform ward sisters and nurses that if there is a male, as a trans person, in a female ward, and a female patient or anyone complains, they must be told that it is not true - there is no male there,” she told the upper chamber.

I’m so fucking furious for this poor victim. How can anyone defend this. I hope they bring charges for obstructing the course of justice.

“During that year she has almost come to the edge of a nervous breakdown, because being disbelieved about being raped in hospital has been such an appalling shock. The hospital, with all its CCTV, has had to admit that the rape happened and that it was committed by a man.”

That will never happen, they said. Not only has it happened but they gaslit this poor woman for a year.

Totally disgusting. I agree 100% with @Palavah. If they want to be stupid then they can at least be stupid in a biological way and admit the person who has a penis actually has a penis, iyswim.
I find it ridiculous and hurtful that a person who complains of rape can be told that no rape can have taken place because they don't want to upset the person carrying out the rape. What about compassion for the victim? Oh wait, twas ever thus.

I don’t generally like people suing the NHS, but I think this might be one time it’s more than warranted. I’m still having trouble getting my head around the idea that the hospital would knowingly do this. Not that I disbelieve it, but it really is that shocking, even in the current climate.

A woman who had been raped was forced to wait a year before an NHS hospital admitted they had a male on the ward. This is inhumane.

There should be a health warning on hospitals pretending no biological men are present on single sex wards..for the safety of the biological women there. If the CCTV evidence is there, how many scared public servants dragged their heels out of fear for their own jobs...the poor victim. hope she is getting a heap of support now.

and it seems they are so concerned about the perpetrator's feelings and rights, not primarily by suggesting that person might have committed a heinous violent crime, but by any suggestion that the perp might be referred to as a male person by implication.
this is like alice in wonderland. a dystopian horrorland.

I'd also support this woman suing or better still, an authority suing on her behalf so she doesn't have to. Like the Crown, for example.

I also find it infuriating that a Sister making a pragmatic decision either to refuse a bed on her ward to an inappropriate patient, or to put that patient in a side room and request 1:1 staffing to protect the safety of all the other patients, would have been thrown to the lions successively by her employer, her union and the NMC.

Incredibly sinister. I hope the poor woman gets the justice she deserves. Not only was she the victim of an horrendous attack, she has been gaslit by those who were supposed to be caring for her while she was vulnerable. I really can’t believe this idea (having biological males on angle sex wards) is actually being supported by the NHS.

The policy is being reviewed by the NHS but as this newspaper revealed, one of those carrying out that review is a “trans advocate”.

If women can have a penis then women can rape, there is no need in that ridiculous language soup to claim that a rape couldn’t have occurred.

I think they have failed totally to keep this woman safe and should be treated as such.

And what if this traumatized woman wants to go to a single-sex rape crisis center for help and she finds there are trans women (biological men) in her support group? And the director is a trans woman? There are really no safe spaces for women anymore.
