URGENT Q re mandatory EDI training and protected characteristics

LefttoherownDevizes · 10/12/2021 11:05

Doing Essential EDI training at work and is telling me that Gender Assignment/Identity is Protected under Equality Act. I've drafted an email to the EDI unit saying that's not true and actually it's only Assignment that's protected, that's true isn't it?

I can't get too involved in this as it enrages me so it's affecting my MH (and DS16 has polar opposites view to me and believes JKR deserved doxxing, after all she's done for him over the years)

Thank you

You are right. Gender reassignment and Sex are in the protected characteristics. Not gender identity

And they are not allowed to rewrite an Act of Parliament to suit an ideology. Widening characteristics to include is one thing, but the law cannot be rewritten by anyone other than Parliament. So the nine protected characteristics of the Equality Act 2010 should be shown, and then if they want to they can add in stuff they also 'protect'.

And no, it hasn't changed. It is still the EA 2010. No update since 2010 (a usual argument).

And nauticant's link shows there have been no updates

Thank you. I've just failed a module as I ticked the 'yes it is legal to positively discriminate' box and the answer was no- unless the time is subject to specific needs (is Yes).

I was forced to read about Stonewall too and it's my worst PMT day of cycle. Might have to go for a walk, poor DH hearing me swear and rant

You are right. Gender reassignment is protected and this is as it should be.
Vitally, when it comes to the legislation the effect is that a male person who is in the process of, or planning to start, gender reassignment is not to be treated any less favourably than a male person who is not pursuing gender reassignment at all. There is no requirement in law that they should be given instant access to resources, opportunities and spaces that are reserved for people who have that other protected characteristic of being a woman due to their status of having the protected gender reassignment characteristic. These are two different things. No one should ever be unfairly discriminated against due to any protected characteristic but it's important to correctly define what is discrimination and what is legitimately balancing the rights of different vulnerable groups when makin their requirements compatible with one another is not simple.

I think the terminology is the query on the positive discrimination question. Positive action is allowed but not positive discrimination.

Aah thank you, makes sense.

Had to break out the kids sweets
