The victim, 'Ms. X', believed she was meeting a lesbian, who described 'herself' as a tomboy.

She only realised her date was a man when he forcibly penetrated her.

The man has been cleared of rape, because the defence successfully argued that the victim " was not a lesbian but a bisexual due to a past relationship history with men, and therefore had no reason to feel "disgusted" or betrayed by Tsang's sexual advances, concluding that it was simply a "miscommunication. "'

So because the victim has consented to sex with men before, she's not allowed to refuse another?

This is absolutely vile. There are no words strong enough.

Whenever I get tired of defending women’s rights, I remember how much men hate us. And yes of course NAMALT. But enough are like that to make the world a dangerous place for women. And few men care enough to oppose it.

So much wrong with this it's hard to know what to object to first. The woman involved is likely traumatised again by the court case and again by the verdict. I can't imagine being told in court that the sexual assault committed against you is actually legal. And that you cannot be a lesbian if you've ever had penetrative sex with a man.

How many women would now even try reporting a rape knowing if they do get it into a court room she'll be treated like this? Every case signals to women.

God knows here on MN we know, if a woman who's been raped comes here for help women will mostly be careful advising her to report it knowing how very much worse legal involvement and the process can make her already bloody awful situation.
