Cat out all night?

We live in a rented student house (in a student, dh isn't), so can not add a cat flap. We have a small back yard, a back door, behind that a metal gate that we can not remove. So we couldn't put a cat flap in anyway. Also leaving a window open all night isn't really an option either.
If our cat is out when we are heading to bed, we always let him in beforehand. But the problem is some nights if he is out (he wants to go just to be clear), when we want him in he isn't around. Once we spend nearly an hour waiting for him to appear because I refused to leave him out. Chasing him up and down the road at gone 1am.
WIBU to leave him out all night if he's not around when it's bedtime (we go to bed late as it is so can't really make bedtime any later). It's not often he's not here, just now and then.

Hi Kel, we have 2 cats,and they are never in at night.
Don't ask me where they go.haha
We were always worried about them being cold so we bought a outdoor Dog house for the garden and put a blanket in it.
Well they love it and use it every day.

I hate hate my boys being out at night. It's completely irrational I know but I'm sometimes out at 2am looking for them. My DH thinks I'm nuts. They always reappear and have most likely found somewhere warm and dry to sleep. If he's out and wants to be in but you've gone to bed, he'll find somewhere to curl up and wait for morning. Or else he'll go hunting and bring you back a "present"…

My cat is locked in after a certain time as I won't let him stay out at night. I've never liked him doing it and since the UK cat killer struck near us I worry even more.

I was considering getting him a small house for our back yard actually? Presumably a pet shop would be the best place? Or online?
And we do live in a city, it's rows of houses with an alleyway at the back, with other houses the other side. He usually wanders up and down there we think. And one of the back yards is partially covered, so we think he goes under that if he's cold.
I would rather him come in every night, but some nights he's nowhere to be seen.

Mines in overnight. I wouldn't chance him out because cats do get attacked by humans.

When he comes in for dinner at 9 he's locked in.
