Independent EP can't see DS until November

I'm hoping to put in my application for a SA next week.

The EP I want to instruct cannot see DS until November.

I really want her to do it but how do you think this fits in time wise?

We're bound to have the LA refuse to assess.

I applied in Feb, refused at end of March. Lodged my appeal in May, date for tribunal was November.

Sadly it will probably take that long especially if they refuse it first time! You will find they often don't 'count' the summer holidays in the timescale - there is something about this in Code of Practice under timescales.

You can always agree an extension of time for extra evidence once you have SA - can't see why a LA would refuse to delay things given the chance!

So I'd reply and then if you get to Sept and looks as though will need extra time ask for it then. You can also submit evidence between getting the draft statement and the final one and again you can delay things then by asking for a meeting on draft statement which halts timescale.

I doubt you'll get a tribunal date before November - it usually takes 4-5 months from lodging the appeal and that won't include August.

The deadline for evidence is usually a month or so before the hearing date so I think you'll be fine. It will be quite good from your point of view to have very fresh evidence.

Keep in touch with the EP and let her know that you're willing to take short-term cancellations (if that's convenient for you). They often get booked up for tribunal dates but LAs cave in before the hearing, so they end up not being needed after all.
