USE OF MEDIATION FOR AN UNFAIR EHCP

Hi. New here. Am about to appeal the outcome of an unfair EHCP review process by my authority for my 10 yr old special needs daughter. I am in time to go for mediation re all the EHCP sub-sections, but being a cynic I fear that it will just waste my time because my authority always ignore any of my requests and it is them who appoint the relevant mediation provider in the first place. Thus I doubt, unlike a tribunal, that the mediator will be trully independent. I may just ask for a mediation certificate and take things from there. Any thoughts appreciated.

Personally, I would just get the certificate and submit to SENDIST.

BTW, you can’t appeal all the sections of the EHCP. Only some of them.

You are probably appealing to the wrong place.

Ensure you appeal to the SEND Tribunal (and not your local authority who have already rejected you). The issue is not many people know about this or try it but there's a 99% success rate, and it worked for me.

I don’t think the OP is. They mention Tribunal. They also mention getting a mediation certificate first which is what the process of appealing to SENDIST is.
