Ehcp but pulled child out of school

My child has speech sound delay and phonological disorder so he speech isn’t the best however certain teachers have claimed they can understand most things he is saying. My child has an ehcp 25 hours per week funding 1:1 or 1:3. I have pulled my child out of school this week due to an incident happening in school where my child’s head was smacked off the floor by another child but I wasn’t informed. When my child was distressed upset explaining what happened to him the teacher couldn’t understand him and they just left it. This is the final straw for me, this school hasn’t been following his ehcp at all and ive been fighting with them about this and ive had no luck. I have emailed the school this week stating my concerns and that I am keeping him off until they can prove they can meet his needs and ensure his safety. Shall I contact the local authorities now or wait to see if the school offer me an appointment. If school doesn’t resolve the problem I will be pulling him out completely snd home schooling until I find a school to meet his needs.

Request an early review of the EHCP. You make this request to the LA. On their website, IPSEA has a model letter you can use.

LAs are ultimately responsible for provision detailed, specified and quantified in F of the EHCP, and it can be enforced if necessary. If provision detailed, specified and quantified in F hasn’t been provided, have you spoken to the LA? Although, you need to look at the wording in F. If it is vague and woolly rather than detailed, specified and quantified it cannot be enforced and needs improving. This can be done via the review process, then appealing if necessary.

Personally, I wouldn’t deregister and EHE. If you do that, you relieve the LA of their duty to provide education. Instead, if DS is unable to attend school, push for alternative provision whilst the EHCP is being reviewed.

I’d say with LAs - out of sight, out of mind! Another question is - how much speech therapy is DC getting?
