After fighting for 18 months draft was issued 19 December, I have gone through it, it isn't reflective at all of sons needs, has minimal intervention and suggests mainstream with minimal provision, when his school and I agree he needs specialist. What happens now? I have sent it back saying I don't agree, with a detailed outline of why, I can't get hold of our worker she doesn't message back, there is no one to speak to when you call it is an answer machine which no one ever replies to! He has been out of school totally since October,

Once you have a finalised EHCP, you can appeal. Presumably when you received the draft as well as making representations you stated your preferred school? Don’t go back and forth repeatedly negotiating with the LA, push them to finalise ASAP and appeal. Unless the 18 months includes time appealing, you should email the Director of Children’s Services, pushing them to finalise ASAP because they are in breach of the statutory timescales.

In the meantime, if DS isn’t in school and is CSA the LA has a duty to ensure he receives a suitable, full-time education. Are they?
