Teacher report for Annual Review

Hi, my son's annual review is next week and there is no class report from the teacher. Usually we have a report before the review but there's nothing. I have been told they are doing things differently this year and there won't be one.
I think it's a legal requirement but does anyone know for sure?
I was reading the Disability Regulations Act 2014, as you do, and under section 20, it says advice and information should be sought from the education provider. So that means the teacher's report I think?
If anyone knows that would be really helpful.
Thanks.

The advice and information doesn’t necessarily have to be a report from DC’s class teacher. Reg 20 of the SEND Regs 2014 states educational advice from “the provider of the relevant early years education or the head teacher or principal of the school, post-16 or other institution attended by the child or young person”, it doesn’t cover the class teacher.

Hi, thanks for your reply. But doesn't that mean someone from his school? So maybe not a teacher, but someone else? As his school is a additional resourced provision, so if not the teacher, then the manager, or someone who works with him in school.

It means the headteacher or principal (although the information and report will often be gathered &/or written by other members of staff the duty is with the headteacher). DS attending an ARP doesn’t change that. It doesn’t have to be the class teacher and the regulations don’t cover the class teacher (and in many ARPs it wouldn’t cover the head of the ARP either as in most ARPs they aren’t the headteacher/principal of the school).
