Appeal and Annual Review - what not to say?!

What happens when an Annual Review comes around while waiting for an appeal hearing, lodged on the previous EHCP?

I understand that the appeal carries on based on the previous plan.

But - are there any obvious things I should/shouldn’t say at the AR which might scupper the appeal?

Eg I assume that I certainly shouldn’t say I’m happy with the current EHCP?!

Anything else?

If the AR is close to the hearing some people ask, via a SEND7, that the appeal and AR are amalgamated.

If the hearing is further away, often the outcome of the AR is accepted, again via a SEND7, as the new WD.

Just a follow up based on the advice I was given:

• Don't say I was happy with the provision and to list out what I was not happy.


• Don't say I was unhappy with the school - say that the school have done all that they can and that progress is not being made/needs not being met.


• Ask formally for the LA to begin a consultation with other schools
