Still waiting for a school for my son.

All the school we want are full and addmissions team don't seem to be contacting any schools for him. I have contacted schools and they haven't received his details/plan and insist it comes through the addmissions team.

I can honestly see him not having a school for September...and have no idea what to do about it

He has an ehcp and has ASD/ADHD looking for high coin school...he's a very bright boy

@twinkletoedelephant If he has an EHCP it should have been reviewed in the autumn term and then amended and finalised naming your preferred secondary school by 15th February this year at the latest.

Did that happen?

twinkletoedelephant · 20/06/2020 01:24

No his final ehcp named school TBC...and 16 weeks later it still has yet to be confirmed

@twinkletoedelephant When was the plan issued and did you ask for a particular school to be named?

twinkletoedelephant · 19/07/2020 22:34

Still no school place for him, I should mention he is a twin (same dx of ASD & ADHD) his twin has a place.

We always assumed they would go together but the school refused to accept him as they thought he may struggle with transitions between lessons, they were asked to reassess and still said no. By then it was to late to appeal against no school and we are left on the same position now.

I am told I cannot appeal until a school is named

Recently had a letter saying all unplaced children will be placed by September, either remaining at current provision or for a term elsewhere.

I can honestly see me dropping off one twin at his new school while the other is sat at home. Obviously this is having a massively negative impact on him especially as his twin is excited about his new school and wants to share all about his zoom calls and letters :(

@twinkletoedelephant this is appalling. Your poor boy.

Who has told you you can't appeal?

twinkletoedelephant · 19/07/2020 23:01

I was told that I am too late for appeal as it needed to be within 6 weeks of the date of the original ehcp plan which was issued with school TBC.
I didn't appeal as thought he would go to same school as his twin..

Now I need a certificate to appeal and no one seems to know who I can get it from, and to be honest I was told it would probably be next year before appeals were heard as there is a huge backlog, all of which doesn't solve the problem of where he will go- wherever he goes he will need transport for so that's another issue to face.

It's so so sad for him every single day he asks what school he is going to, his twin has his school uniform met staff walked around his new school and made friends on zoom.. obviously he is excited about his new school and wants to share his excitement but that leads to meltdowns.
Poor lad is in tears he just wants a school
And obviously it's all my fault....

You can threaten Judicial Review for failure to amend the EHCP by 15th February.

I imagine OP hasn't got the right to appeal because the LA haven't issued a finalised amended EHCP.

10brokengreenbottles · 19/07/2020 23:09

Sorry, X post, I didn't refresh.

You can still go down the JR line.

You have 2 months from the LA's decision or 1 month from the date of the mediation certificate, whichever is later, to appeal.

10brokengreenbottles · 19/07/2020 23:13

Actually if the LA have issued an amended EHCP with just the type of placement then I'm not sure you can JR. Have you spoken to IPSEA or SOSSEN?

Ellie56 · 19/07/2020 23:58

twinkletoedelephant

Does the EHCP that says TBC say Final on it and did you get a letter with it setting out your right of appeal or does the EHCP still say Draft?

You could try getting an appointment on the IPSEA Advice Line.

www.ipsea.org.uk/advice-line

You have to keep checking though as the volunteers put their appointments on at all times, even late at night and first thing in the morning.

twinkletoedelephant · 20/07/2020 07:52

I have spoken to sossen and they have said I need a mediation certificate, I am unsure who to ask to get one, my son's caseworker is not particularly helpful and seems to just "forward" any emails I send her.
I have heard from other parents jr are very very backlogged and it would've next year before it's heard

@twinkletoedelephant

SOSSEN! should have been able to explain about the Mediation certificat

If the LA have actually finalised the plan they would have sent details about appealing and mediation in a letter sent with it. The letter would have had details on who to contact.

I would try getting an appointment with IPSEA. You will be able to explain exactly what has happened and get the correct advice on what to do next.

Link above.
