Specialist school say they are full, what now?

The school we have named as our preference on DC's EHCP say that they have 'no capacity within the physical resource'.

They are the only school in any kind of reasonable radius that are suitable for DC.

Can I appeal against this decision? I've been all over IPSEA and local SEN group pages but nothing seems clear.

If it’s a S 41 school, then afaik, there is nothing you can do! Nobody can tell an independent school what to do?

If it's an LA school they can not refuse a place purely because they are 'full'. If you took it to appeal, the LA would have to prove that placing your child there would be 'incompatible with the provision of efficient education to others' i.e. giving your child a place would have such a significant impact on the children already there that it would be unreasonable to offer a place.
