Told I can't claim ESA for 16 year old as he is still at school

My DS receives DLA at highest rate for both components. He will turn 16 in September and I have sent in claim form as I was told I (as his appointee) can claim from age of 16 as long as I am no longer claiming child benefit or tax credits. Today I have been told that he will not receive anything until he is 18 because he is at school. But the regulations state that you can receive income-related ESA if you get DLA. Can anyone help me to understand this more please?
