tribunal number 4 will be held in mid june so that's good as I may just find out the decision before she starts secondary but means that there will be no transition but then as im going for an indie school anyway im not overly upset. if we lose then she will be home schooled so at least I can get that all sorted for sept if I have to.

LA currently sat thinking that we will be doing transfer to EHCP two weeks today but I need to serve on them an addendum to the appeal so will do that tomorrow and let them know we can still meet and discuss the issues if need be and come to some agreement (or not) as we all know they intend to shove her into a mainstream school - ive called their bluff now I guess if the plan ever was not to issue an EHCP at the end of the assessment.

wonder how this is going to down given that im appeal number 1 listed in my LA in 2013, 2014 and 2015 - bet no one else holds that record! and in 2014 I had 2 appeals

Wow. I hope you got some robust directions with that tribunal date, too.

If you can just get your foot through the door of your indie school before they can get EHCP finalised it would be great.

im in semi limbo now with the EHCP especially as the meeting is fixed for 2 weeks time - hopefully the addendum which I will send to the LA tomorrow will explain more clearly why I have done what I have done. they will instruct a solicitor and barrister against me and then they will deal with me not the LA officer. I think the LA will take their anger out on the barrister as he persuaded them to do what they did as they did not want me to have a statement on any terms whatsoever as I have done exactly what they feared and moved to to get an indie school for her. if they could have blocked me at the NIL appeal then they would have been okay but the are on very very dodgy ground and they know it.

That addendum sounds interesting. Shame you can't be a fly on the wall as these things land on their desk.

How is your dd coping at school at the moment? is it SATS year? (Don't have them in Scotland).

yes its sats year for her - shes not coping at all - yesterday was a particulary bad for her - im not sure if we will make it to the end of the year - its all falling apart now and not surprising as she is academically 4 years behind, has asd so the social side is overwhelming her now as well, she has just started her periods as well, had to see us go through 2 tribunals and is getting no more help now than when we started this 18 months ago. the only thing we have learnt is that we now have 3 kids with asd and a dd who is going through hell and no one seems to care

Well I would love to be there to cheer you on. Seems like we are doomed to be taken to appeal at every step. This is a mental picture for everyone to hold. This is us at tribunal ;0)

Flowers can you pull her out of SATS? It'd be one less stress for her, and the only people they matter to are the school.

Shame as I'm counting on my sons sats to show his true levels. School say he is at the top end of nc levels but I'm sure his sats will not reflect that.

Hard choice to make.

the SATs levels are fake anyway as the school give her all the necessary adjustments in the tests which she doesn't get during the normal school day - thankfully we have standardised testing which shows her true levels plus our EP will also test her again . I so want to pull her out of school now but I have to carry on I guess.

LA know now as just had a letter from them asking if I got the 2nd statement they issued - think they think the 2nd one makes everything okay as it was issued after I appealed - thing is 2nd version is even more unlawful as got the reports in part 2 but no provison in part 3! will serve the addendum to the appeal tomorrow which addresses that and confirms I got the paperwork. so I think they think Ive appealed in error and not realised my mistake.............

2boys - is it KS1 SATS you're looking at? If so, be aware that they're based on teacher assessment, not externally-marked exams. Check here for more.

The school's assessments will be externally moderated. At some point in time over a 4-year period by... the LA.

This gives schools have a large amount of creative licence say over the results. Sometimes, it's in their interest to keep KS1 assessments low. Sometimes, it's in their interests to keep some of them high - check this for more.

Either way, if you were counting on KS1 SATS to show your DS's true levels, you might need to think again.

no senvet - we simply cannot afford it - won a 70k indie placement before sure I can do it again - just to get the witnesses and updated reports I don't think I will have any change out of £5k so a solicitor is out of reach sadly so hence lots and lots of research again.

The SATS thing must be a real issue for your poor dd. Even if she doesn't take them herself, I can only see that they would add stress and change to the whole school environment. Could she go part time? I know there are a whole other set of issues attached to doing that though.

I have two indi ep reports to show ds can't be a nc expected levels so I'm not relying on the sats, I just hoped they would be below his nc levels.

My school aren't smart enough to fix sats I think. He was at p levels starting in year one and at 1a end of year one. But all progress was in one term so any fiddling don't add up in the appeal. I don't think they can piece these things together.

Let's hope not anyway

I have a rubbish memory but I thought a solicitor did your addendum. Sorry to be curious. You will be fine. It is just a darned shame you have been mucked about by the Tribunal with this statement ehcp nonsense.
