I haven't seen you post after a stressful time the other week. Please tell me you haven't been arrested for kidnapping your LA SEN and dropping them over a cliff?!

I hope you have managed to clear a space and have taken some well-deserved time out.Flowers

trying to remember how far I had updated - anyway appeal is in - no date yet but think it will finally be listed today so expecting a date asap - may phone them this afternoon to see what the date is.

she had a successful trial at the indie school and they have offered her a place so the fight now is a full on part 2 3 and 4 appeal for an indie placement.

the LA have been silent but her class teacher grabbed me yesterday to say the LA have been in touch and was to fix a date for the EHCP meeting in about 2 weeks time - teacher has let it slip that the plan is to issue a dire EHCP with minimum 1:1, no salt or OT and dump her into the secondary school 10 miles away as that's the school the LA are going to name. quite how we will now go forward once the appeal against the statement hits the desk = who knows?

have had some excellent advice from one of the sen charities -t hey have wrote an addendum to my appeal which im just waiting to serve once I get the date through saying that the statement is now completely and utterly unlawful - they have added a paragraph in part 2 from our indie reports but have not put anything at all in part 3 - they even added that she has considerable sensory processing disorder difficulties but then want to dump her in a mainstream academy - I think not!

the LA have also responded to my costs order - got their barrister to respond - they are saying I should have asked on the day for costs and my witness should only be refunded £48 anyway. the barrister quotes the consent order but also quotes something else which isn't written in the actual order which now screws the LA as they haven't done what was agreed.. I was panicking cos the consent order didn't specify it fully but this reponse from the barrister does so that's very helpful. he also twitters how the judge thought he was amazing but fails to mention the judge told him he had no chance of winning but hey ho!!!

Their barrister isn't as hot as he thinks he is. If he was, then he'd know that there are legally set timescales to appeal for costs and that it doesn't have to be done on the day of the hearing.

I know towie cos I did my research!!! will draft a response over the weekend as have until tues to do it. I know I don't have a hope of getting them but its only the time of an email im losing.

I have the offer now in writing of the school place. the letter made me cry as after months of looking at the negatives the letter spoke of the many positives my dd has and how happy she was at the school. in the dark days ahead of me im going to get that letter out and read it and it will focus my mind as to why im doing this for her.

it Saturday tomorrow so no doubt there will be a lovely letter from my LA in my post box. the lovely LA will have to wait until Monday for their appeal notice from sendist

I'm so disgusted for you, I really am moved by your story. You will get them - in the end. I know you will. I'd love to be there to see it.

What kills me is that we are in the same boat but were fighters. What about those parents who aren't? God I could be physically sick my blood boils.

Been told to let my fights go, I can't. Statement is due next week.

When I'm done people's heads will be on sticks on the four corners of my county and if that kills in the process so be it. I can't let it go. This is so so so wrong

Well done for keeping up the fight. It is great that you have found a school for your dd; it will give you that extra to keep going as that is a light at the end of the tunnel. Your dd sounds like she is an absolute star and I'm sure she will blossom in the correct place.

I am only a year into a fight for a plan for my ds and he is mostly getting the support we think he needs so we'd be happy with a plan which just says what he is getting but even then our LA are so obstinate. I can't imagine the stress you have been put under. I hope you can 'box it up' some days and just have fun as a family.

well no letter from the LA came today so looks like my theory on a Saturday is right - im actually keeping a log as to when the LA correspondence comes so I can show people the depths LA go to to time letters landing on your mat on a Saturday to try and upset you for the weekend - lovely when they know we have 3 children with SEN.

its hard bilberry - been here 4 years next month and ive fought every step of the way for 4 years solid with each of my children - I just win one fight then I have to battle for the next child, its never ended.

the good thing is that this year the next tribunal will be in june so no matter what happens I will not be fighting over the summer holidays which will be the first time ever since ive lived here

urrrggghhh phoned sendist earlier and still its not been listed :-( now been 2 weeks they have had it. im panicking now that the LA will serve the transfer to EHCP notice on me tomorrow unaware that I have lodged an appeal. sendist also said that fast track appeals are being listed end of june /early july so this is going to go to the wire - the indie school we want closes for the summer on 3/7 and my own dd finishes school on 10/7 so she will not know her secondary placement for sept will she?

plus im going to have to fend off a local mainstream school trying to push transition onto us........... there will be no transition into any mainstream school - im not giving them any opportunity to try and gather evidence against us

Fantastic news that it was such a positive report from the indie school. Pin the letter up and when the going gets tough, re-read it again.

Our Tribunal was similar with regard to timings. We had a July date and then didn't find out until early August that we had "won". The Tribunal-ordered Final Statement didn't turn up until the day before school started in the September. But the indie school knew exactly what was going on, despite it being the summer holidays, and welcomed him with open-arms on the very next day on the first day of term. But it was a mad dash to the school uniform the day before!

my strength comes from my amazing dd. just been out to the shop with her and she was saying how she asked to be excused from class today so she could go for a cry in the cloakroom as the noise in the class was just too much for her - there are 12 kids in her class! she then sorts herself out and reappears as though she is 'fine' it was French today and she has no idea what on earth she is doing or understands any of it.

heres hoping next week the tribunal date finally appears
