individual assessment 1st percentile statutory turned down twice

My son is going into year 3 had ed psych report that shows using the wechsler individual achievement test second uk edition that he is 1st percentile for word reading and 2nd for spelling ed psych made 14 recommendations that he requires yet a statutory assessment has been turned down twice any one in the same boat or has been??? Sick to death

No diagnosis they tested for downs syndrome and fragile x syndrome few year ago but was clear they just keep saying developmental delay and learning difficulties school uses lexia and dyspraxia courses with him and magical spelling instead of phonics ed psych says its his working memory and processing speed which is particular difficulty meeting to discuss support plan today

If you don't mind sharing what were his scores on his cognitive assessment? Or the other WIAT scores? Were they low too or average? I ask because if only two of his scores were that low he might not meet most LA's criteria for assessment.
