so according the to class teacher my daughter still wont get a statement post tribunal

because she still wont reach their LA threshold of being more than 6 years behind!!!! my LA have a similar threshold

this is the teacher who as we know has done everything to make my daughter appear to have higher levels and was torn of a strip at tribunal by the judge and made clear that LA policy doesn't matter - she cant understand that as all her senco training has told her otherwise.

The LA EP told me that hes doing no further assessments but has told her he is doing some cognitive assessments so wonder what he is doing

at the hearing she assured the tribunal given DDs low levels in the SALT report she would refer her to the specialist teaching service - shes made a phone call and they have no idea what to do, shes spoken to their LA EP and they have no clue either - with the OT report they said I should go back to the NHS OT and get them to provide equipment for her

daughter had an awful few days at school due to bullying etc so teacher spoken to the class and explained how different my daughter is to the other children and how they should make allowances for her

can anyway show me the way to the brick wall to absolutely bang my head against it!

also the sen officer was bitterly complaining to the class teacher about how the LA here has delegated all of its specialist teaching budget to schools so school have the money. my school in a different LA and my teacher clearly is never ever going to refer her to the specialist teaching service not even the dyslexia part

teacher is now worried about where will my daughter go for secondary placement.

came out yesterday wanting to scream - daughter not in school today as has an OT appointment which is quite a distance away - teacher said 'oh don't worry if it finishes earlier, don't come back, I would go and have an afternoon shopping in primark!!'''

Smile sweetly and give her a copy of the code of practice. Point out that the SCHOOL should go back to the NHS OT with the report and get help in making those reasonable adjustments that the law requires.

What year is she?

sounds like the senco needs some serious training in line with SENCOP. I would be tempted to suggest this to the HT Grin

I'll hold hands with you as mine is also year 5 & am stressing over secondary transition. Just this minute found out that the mainstream catchment school nearest the house we move to next week contains an ASD unit that DS is not allowed to access despite the new LA's own assessment putting him at 1% receptive language????? It's mainstream or bust for them & they are trying to say his home ed isn't suitable.

Just gearing up for Tribunal in the autumn over secondary & am truly fed up now. Just want to hand it all to a solicitor to deal with as soon as we have the new correspondence address cos I really cba tail chasing.

Has she been to tibunal before tell her b off. She is wrong.

She was in my last tribunal a month ago when the judge told her they were not interested in 'policy' just law and yet she's still spouting it because all her training from the LA is that unless they are about 6 years behind they do. OT meet the criteria for a stat assessment.

It doesn't really matter what she thinks, though, does it? Either the LA will have a burst of sense and agree to issue a statement, or they won't, and you'll have to go back to the tribunal again. It's not really worth wasting your energy on arguing about it with her.
