although my joy will be short lived no doubt with the forthcoming NIL - the teacher came out of it quite well - they were impressed by her but said that undoubtedly the level of support she was getting no could not be provided at secondary re class sizes etc. they also made no comment that the LA had provided no reports etc BUT this is the bit that concerns me and which I reckon the LA are going to throw back to us at a latter date

'it is not yet possible to state, once, identified, those needs would be so substantial that a mainstream school could not meet them effectively from their own resources but without a statutory assessment it is impossible to reach any firm conclusion about the necessity for a statement'

That last paragraph pretty much says "how do you know whether she needs a statement or not, if you won't assess her, you numpties?" Only more polite, like.

really should check my posts before I post them - they made comment that the LA had submitted no reports

also in the child views - remember the kerfuffle over that - its the views my daughter wrote at home which the make reference to Smile not the ones the LA had re done

Yay! There is some justice in this world!!! So happy for you!!! No it's not your last fight, but if you do this, you can do anything. They are less likely to issue a nil to mum that fights back - but it does happen.

I would think that the judge's remarks about still not knowing at this point if a statement is needed, is directly in response to the LA's claim that if SA was done, it's likely it wouldn't result in a Statement. The judge is crossing all the t's and dotting all the i's so there's no come back on their decision

And it's also plain common sense!

There has to be an official rule that you are only allowed to celebrate the victories without worrying about what the next stage will bring. You did it - which really means that your DD's needs 'did it' - it is so easy for us to forget that our DC do have what are actually pretty obvious needs, when the LA seeks to ignore, minimise and refute them.

Glad you didn't have to wait too long for the decision in the end.

decision was issued yesterday so was 8 days from the hearing and 9 days to we received it. the judge did say that she would do it as quickly as she could and within the 10 days - she had had an appeal cancelled that week so I think that's what helped it to be so quick.

no doubt in the following weeks I will be back for some advice! I would love to be in the office of the LA today - how do you think they will explain this one away - was I really just lucky again, am I really the mum from hell who over emphasis's her childs needs? who knows - bit I will be having a better Friday in the sun than them!! its champers for us down in the summer house later followed by a bbq plus we already have a sitter booked for tomorrow night so a fantastic weekend ahead for us and all with the sun shining Smile

hmmm would think any chocolates from the LA would be laced with something unpleasant now after our second win

the teacher will be comforted by the wise words in the ruling about what an amazing teacher she is. if anything now ive read it a few times the judgement is more against the LA than the school. it acknowledges that she has a lot of support at the school but will not access any of that at secondary. it also makes more than one reference to the fact that my LA don't have any specialist teachers that she can access once she comes back into county.
