Advice on Part 4 of SEN

Hello. I'm looking for some advice about part 4 of my DS' statement. We are due the final statement in the next few days but we have a problem. Our LA want to name our son's current nursery as his placement under part 4. However, he starts school in September 2014 and we have requested a SS. The LA are refusing to name this school on the statement and will only name it on a EHCP from September 2014. I have spoken to IPSEA who said to take it to tribunal but I wanted to see if anyone else had experienced this issue. Not to drip feed - SS have accepted DS as suitable for a place and I am aware that EHCP have no legal standing as of yet.

Does he have a school allocated to him from Sept 14?

Transition placements need to be sorted by mid-Feb usually and if they aren't then they need to get a move on, not delay until Sept.

That sounds really odd. We are waiting our amended statement too but they said they would name the school on this (moving from pre-school to start SS in sep). Surely it has to be named otherwise you don't have a school to go to from September??

It isn't a problem to name two placements in Part 4, so long as it's clear when each placement starts - it's rare for this to happen though unless it's a phase transfer (nursery to primary, primary to secondary etc).

After our tribunal for DS1, we ended up with a Part 4 that said "DS1 will attend [mainstream primary] until the end of the 201x-201x academic year. In September 201x, DS1 will attend a [maintained SS secondary]"

How weird... Why are they doing it?

I'm going to Tribunal in order to keep ds back a year in preschool and start SS next Year... Have not heard about your situation before.

It's all sorted - school is being specified from September 2014 after we informed LA we would appeal at tribunal. It is a transition from nursery to school but the SS only has a handful of places.

But you need it specified in the document you have now which should state the from September it will be x school. You can't trust them to add it in September.

It is going to be added to the current statement - this has been agreed and we will only sign the new final statement once this has been amended.

Just a small point, but there is no requirement for parents to sign statements.
