Both were successful!! I am soo happy, I have just had a brilliant week away with the other family that called me as a witness and during the week we were both notified that we had won our tribunals.

Both our amazing children who have similar dx's are now going to be assessed.

Thanks for all your good wishes and honks I am sure they helped Grin

I am so relieved that all the work wasnt wasted and we are one step closer to getting both childrens needs met as they move towards the next step on their journey through the education system. Smile

There seem to be a lot of us getting a refusal atm but the LA are either conceding after appeal and before hearing or are losing the hearings.

The one thing that we all have in common is that we were told we had no hope and it was a lie.

Thankyou, I have read the letter carefully now, they have told them to assess based on her Asd being a disability which causes her anxiety and that the anxiety is a barrier to her learning!

They also said they are surprised that the LA have said she doesnt have a learning difficulty based on the amount of support that the school have put in place and the fact that she is on SA+ on the CoP!

Do the LA get the same letter??

Yes they do.

Was it the same LA in both cases? It might be worth showing the decision letters to a councillor and getting him/her to ask questions about how they got it so wrong at least twice over. It sounds like they shouldn't even have resisted the appeals.

Yes it was the same LA the whole SEN department is some kind of cruel joke!! No one is responsible for anything and they all just pass the buck around the building!!

Believe me when I say it is bad, we are not the worst off there are families in even worse situations than us Sad

Will look into speaking to a councillor and one of the families going through hell is in touch with her MP.

youare No it definitely wasnt easy, the most stressful 2 terms I have ever had!! I really hope things stop being quite so insane and that the LA just accept that they need to just do their jobsHmm
