RefuSal to assess - school now going to call in EP

After refusing point blank to get her to see an EP a year ago as she's. OT more than 6 years behind, us applying for a statement, being refused and 6 weeks to tribunal with teacher being called as a witness, and stating a few weeks ago they would never ever call the EP in, class teacher /Senco tells me today that after speaking to the sen governors they have agreed to fund an EP to come into see her as I have so far had to pay for an EP assessment, dyslexia teacher and OT report - complete turnaround. Teacher made it clear assessment nothing to do with statementing? I'm confused as how will she know what the EP will say? My school in different area to my LA so I don't know who the EP is - should I be concerned? Given with the school Easter holidays the school if in cahoots with la have just 4 weeks to organise and get the EP in.

My indie salt report came in today -it's poor and she's on 2nd centile for working memory so that's every report now and expressive language she's 1% plus scores low in other areas as well. Now waiting for the OT report to come in

It gets mad in the run up to tribunal. You are lucky? (not right word at all but you know what I mean) to have experience here.

It's like, the worst the LA case, the more odd they get, and the more unpredictable and silly.

You know then you've got a good chance. You just have to hold it steady and try not to lose it.

yes - and i have been here before - its funny but i was reading my sons file earlier as i was looking for something and it bought it all back how badly they behaved back then and it was their behaviour that lost them that tribunal. reading the stuff they wrote behind my back to the tribunal - even the tribunal staff were completely confused by them as we had a pre case hearing and the staff put explanation marks next to some of the comments the LA made in the phone call as they were being so ridiculous - that led to a hearing with a judge and they got ripped apart

They need more evidence but the clock is ticking. You need to delay until it becomes impossible to collect evidence in time. Once my LA knew I was asking awkward questions and would likely not consent they agreed to assess.

dh has come home and explained what has happened - he knows exactly whats going on and he said straight away - the LA are behind it so hes going in tomorrow with daughter to make sure she hands the little note over to the teacher - shes so dipsy she would forget hence why she needs an escort dh happy to take questions if asked!

well the letter went in today to the teacher thanking her for the kind offer and her kinds words about what amazing parents she said that we were by orgainising all of these assessments for my daughter :-)

ive said no to it now but would be happy for it post tribunal - only 6 weeks away and easter in the middle. ive asked for a copy of the referral form for me to consider.

teacher came out with her at pick up, didnt say anything but i was definately singing 'awkward' in my head - so now we wait and see if anything else happens. final evidence is now 9 days away so something is going to happen - i predict theres going to be a phone call by the end of the week asking for a 'meeting'

i guess thats it - i think the teacher sensed we were on to the cunning plan and might be a bit miffed that weve kind off thrown this kind offer back in their face. i bet if we lose the tribunal there will be no EP assessment - the school will just forget to do it. my other saving grace at the moment is that the head is off sick, the only other teacher is leaving in 2 weeks so the class teacher/senco is kind off running the show at the moment so she could be doing without these games being played but then who knows - she could be very happy to be party to it - she said yes to being a witness rather quickly

Does she gave designs on the acting head position?

i bet she does as she does come across like that. i call her the smiling assassin as she is nothing but pleasant to me but her actions tell me shes not to be trusted at all. the head hasnt spoken to me i think since about july last year. she was off sick then then her mum died and since then she has barely been in school and she is off school again - school is meant also be converting to academy on 1st april and head had given an assurance she would stay until 2015 - i have a feeling we wont see her again so yes i guess the teacher will be looking to lead the school as shes the last one standing!

So... smiling assassin vibe is all in the past, and hoping to be head of shiny new academy in a week's time.

Forget what I said before. Clearly nothing to worry about.

It's probably more likely that the academy chain will fly a new head, of their choosing in, toute de suite.
