Can someone please tell me what happends after I sent back proposed statements with amedments?

Just realised I'm not sure. I rewrote the whole thing ( with a help) and calculated they have until Sunday to issuse final Statement.

What are they supposed to be doing in that time? Contacting schools? Working on the amendments?

Can they name school I don't want without telling me?

Preschool said no school contacted them to ask about/ see ds.

they should consult schools, there is a small chance they could name a school that you don't want if all of your choices are full or the LA don't agree. the may or may not agree your amendments. hopefully you should get it soon. then of course if you are not happy then you will get the right of appeal. these things tend to arrive in the post on a Saturday as well

We share the same LA - lucky us! Yes they can name a school without telling you. In my DS's case they named a school 45 minutes away down a busy London-bound motorway and into a large town - a school which I'd never even heard of - let alone knew any child at the school! (Then the LA had the cheek to say at Tribunal that if littleTowie went to this school, he'd remain in his own community with his existing friends!!)

They are supposed to consult with both the school they name and the school you want before the Final Statement is issued - both the Education Act and the SEN CoP stipulate exactly how this should be done. But again, our LA has "form" for not doing this - instead they might issue the Final Statement and only then retrospectively consult with the school because of their own incompetence means they run out of time They may even not give their proposed school all the reports on your DC. However this is all in breach of the statutory regulations. It is exactly these reasons that the LGO is now investigating in my DS's case. I'll be very interested to know if the LA has done the same in your DC's case

Thank you. I doubt very much they will name the SS I want, and I won't agree to anything else.

Towie, I have done the information request so that's going to be interesting..

I'm meeting the Head of SS in 2 weeks, so might know more then.

I really do hope you get the school you want for your DC. I really do hope my experience was "one-off" (as they claim). They've already given you enough of a nightmare leading up to this point!

However, if they don't name the school...

When you get the DPA material back - look for gaps and things that just don't make sense - particularly if you've requested DPA searches on multiple agencies.

In my DS's case, the LA failed to disclose a vital document. But it was disclosed elsewhere by another agency. It's this document that the LGO is very interested in because it directly contradicts what the LA have told the LGO about how my DS's statement was finalised.

Hope you get the Statement this weekend and it's good news.

Towie I only sent the requests to the old and new preschool and LA - does the LA include NHS therapists?

Thinking what other agencies could be involved :)

When you get the Final Statement, if it's not the school you want, then definitely send DPA request to the school they've named. You might be surprised at what doesn't turn up. Wink

If it's the wrong school, you may also want to send the named school a very pointed FOI request to determine if they can actually meet your DC's needs. The FOI I did showed that the LA's named school could not meet my DS's severe dyslexia at all (FOI showed no experience/no qualifications/no other dyslexic pupils/no clue). The FOI also showed that although the school had a SALT unit, this unit also could not meet my DS's SALT part of the statement (once it had been quantified and specified via Tribunal) because it was under resourced for a q&s Statement.

When we got to Tribunal, the LA & school had a very hard time convincing the Panel that they did have all this experience/resources/similar pupils etc when their own words via the FOI proved otherwise.
