taking on an ABA tutor who is from outside the EEA

I have found a new ABA tutor who is Canadian. I haven't yet seen his passport/visa so I don't know the exact position, but does anyone know where one stands in paying a tutor who is working in a self-employed capacity who is a non-EEA citizen? I'm clear they'd need a permit if they were my employee, but he won't be, and I'm not sure if that alters the position.
