When LA gave draft statement, they also said they "would approach indi school" after i wrote to them stating ds had a place there and could start as soon as they provided funding. They then issued crap draft statement, which i am disputing with them currently.

Anyhow indi school have just email me to say "they have received consultation from LA" and how would i like to proceed?

It isn't necessarily over with this indi. Honestly, ds' school rejected him. Our solicitor at the time looked at me all confused and said, 'you've given up on nothing so far and all of a sudden you're giving up with this school!?'.

So I phoned them back and got them to see him etc. If your concerns and their concerns do not match then there may well be room for sorting something out.

and what agnes said.

They have agreed to meet and assess him, part time, over several days.

I dont want the LA to use his previous school is the only school who will accept him because he is still on roll there. If indi school with specialist provision on site, cant meet his needs. Then there is no way previous MS school, who were appearing as witnesses to say ds doesnt even need a statement can.

claw, don't get into a panic over this. Forget the old school. You have moved on. You have moved away. I cannot see a tribunal ruling that now.

Indi school have replied to LA "Thank you for your letter regarding the above-named child. Whilst I have no doubt that ds?s cognitive needs could be met at xxxx School, I have some concerns regarding the very high levels of anxiety that he appears to experience, about a number of aspects of school life"

Could i ask for a copy of the letter that LA sent school?

Yes of course.

There is nothing wrong with that letter from the indi btw. It indicates greater need, not that he'd be better served in a ms state school.

Indi school letter goes on to also state about assessing on a part time basis, over several days and asking LA to fund etc, etc. So they are not saying they cant meet needs, just that they have concerns.

Im just wondering what the LA put in their letter to indi school to make them think very high levels of anxiety etc, etc after playing it down for years and in ds's statement!

Maybe the school are planning on saying they can meet his needs provided some additional resources are funded.

They also mentioned 'smaller environment than this school'

Baston is a bit far, about an hours drive. Especially as i dont have a car at the moment

Anyhow they have agreed to assess ds, part time, over a period of time. We will see how it goes.

Thanks everyone for your help

But he has very high levels of anxiety doesn't he? Presumably the draft statement notes that?

Did your EP assess this environment? Hopefully it will be fine. Are you convinced it is the right place for him? If you are, stick with it and see how he gets on.

IE the draft statement in the whole of part 2 does nothing but speak about the progress ds has made in all areas basically and how school report "ds was happy, enjoyed school" etc, etc and 'mother reports' the opposite etc (although ds reported this to all experts and its written as his reporting, not mine and well documented)

Although in the summary of need they list school anxiety and self harming.

Objectives: to manage his high levels of anxiety

Provision: help to manage his emotions and to deal with worries and anxieties. Continue to get advice from CAMHS

EP did not assess this environment, EP assessment was part of LA's refusal to assess 5 months ago.
