funding cut from health for respite

Hi - we have had our respite funding cut in half as health have moved the goal posts and my son no longer qualifies - he is quad cp, dystonia, scoliosis, tube fed, deaf, VI, in pads 24/7 with limited communication. Has anyone else experienced this ? can i fight it ? I would be grateful for any advice. Thanks

down to assessment. Then call your local PALS department and ask them to help you formally challenge the funding decision. Ask whether this was done.

I don't know much about health assessments. I know for social care packages they have to do a reassessment before any change and if they change the eligibility criteria they have to consult first. A lot of cases are successfully judicially reviewed on lack of consultation / failure to do a reassessment. You should get legal advice if possible. There is some legal info on Council for Disabled Children website by Steve broach a barrister - mainly social care - has a list of specialist lawyers. I know Irwin Mitchell have been involved in many of the recent JR cases. You may get legal aid for JR. There is also a health service ombudsman but they can usually only look at the process not overturn the actual decision. Involve your MP too.

Good advice given here but I would echo finding out what guidance is issued at a national level about these assessments.

I challenged a cut in care with the LGO for my brother, who is an adult with disabilities, and they ru ed maladminstration as the LA hadn't followed guidance.

Who is responsible for making the decision? LA or NHS or both? I am using Irwin Mitchell at the moment for a JR and Steve Broach. I'd be happy to pass on contact details. PM me.
