Had just sent an email setting out all the reasons why we are going to tribunal and if they weren't going to reconsider then no point in going to meeting to discuss Note in Lieu.

Just had call saying that they are aware that they don't have an up to date SALT report but have now been made aware that DS has been attending Social use of Lang summer groups. I had sent them in with request for stat ass.

Anyhow she is asking for it to go back to panel (with "new" info) but this may not be for 3 weeks. So she wants to know do I want them to issue the NIL now and wait to see what panel says in 3 weeks before appealing or hold off to see what panel says.

To be honest the report from summer group was not all that great, didn't pick up on his sensory issues etc and I have pointed this out to the LEA.

Hope this makes sense...

Wtf?

Tell them to issue your NIL so you don't risk any further delay, and to go ahead and have their panel anyway as you can always withdraw your appeal if they change their minds.

They are completely barking I tell you. Yes issue then I can always pull out of appeal. Is that going to be ok with tribunal?

Yes of course.

If you want to justify it you can suggest that it woukd be unreasonable of them to expect you to okay a delay in needed provision because they made a mistake. Your chikd's needs are urgent after all. But with the appeal in and anytime before or after you are more than happy to work with them etc etc.

How were they made aware of this 'new' information? Good advice already given. I do hope they back down, although you are right to try to not get your hopes up - hard though, isn't it?

Hi Steele, I had rang SALT dept saying I was concerned as DS didn't have a current assessment which I felt should have been included in his stat Assessement .

They must have rang the LEA and told them that DS had attended social SALT group during the summers for last three years. BUT I had told the LEA and sent them the latest report back in Feb!

Have followed advice here and emailed tonight saying yes issue the note in lieu, still willing to talk to them, take it back to panel and if decision is changed then will withdraw appeal.

Have aged considerably over last few months...

I bet you have!

I'm still in the process of trying to get a SA. Tribunal is months away. Our case was also taken back to panel due to 'new evidence' but they refused again. I have been advised that even if they end up backing down or we win the case, we would most likely end up with a note in lieu and having to appeal again.

Good luck to you too Steele! hope they back down for you. If they don't do an SA how can tell what the issues are? It is awful,all this waiting.

Latest from the LEA - Still haven't received the Note in Lieu.

Have told them I want them to issue it so I can lodge my appeal. They are still going back to panel with the summer social use of lang group report - in my opinion not very detailed and a bit inaccurate which I have told them (and put in writing)

Have heard from the LEA speech therapy team and DS has two assessment appts in August.

Case officer is getting back to me Monday to tell me when I can expect the NIL.

I am feeling very stressed, feeling very messed about.

im not surprised - they are messing you around whilst time is dragging on but without the NIL you cant also move things forward - they just delay things im sure just for delays sake and forget that there is a child at the end of this.

thanks bjkmummy, it is awful and they really couldn't give a toss about the child do they?

Started the process in January and it feels that I am barely further on. DS in the meantime is still stuck without an education. Am on a right downer today!

i feel for you i really do - my son had an emergency review on 31st may - school stated could no longer meet his needs even if he had a full time statement and that he needs a special school. he is being sick every day due to anxiety at school - he ended up out of school on thurs and fri and still undecided whether to send him back in tomorrow as hes now started to vomit at home. lea couldnt seem to care less - paperwork went back to them on 1st june it then went missing and they finally got it last weds and noone yet looked at it. they hope to do so next week - only a few weeks left to end of term - school dont want him back in sept - i cant even go to tribunal until i get the statement back and there is no time line attached to it in law so lea can drag it on for months - its pants and at the end of it is a boy who is now becoming very ill but everyone seems to think its okay. im fed up of nagging people to actually do their job - ive not yet found anyone with a hint of compassion for my sons suffering. and the impact it has on us as mums and our own mental health is ignored as is the stress on the rest of the family

bjkmummy that is awful :(. The anexity is awful isn't it? Your poor DS, I can really understand what you are going through. DS barely leaves the house and I realised yesterday that it is nearly a year since he started to get ill, more anxious, not coping, struggling to cope in school.

You are right the mental stress it has caused to the whole family is enormous.

Really hope you get some answers next week, how are you supposed to look for other schools if they don't liaise with you? What a mess the system is.

sigh - hes just been sick 5 times this evening as he knows he is going back to school tomorrow - dh adamant we should send him but im not so sure - think im in for a long night .......

If he is that anxious, keep him home and go to GP in morn and get DS signed off as too ill to attend school as he is too anxious.

Hope your DS settles tonight and you both get but of sleep :(
