Almost finished my SA request, would just like some reassurance about the following;-

IEP's school are claiming targets have been met. The success criteria hasnt been reached.

For example 'ds to get changed for PE within a given a time limit 5 seperate times. Evualation section says 'last time he was observed, he wasnt last'. Target hasnt been meet has it?

Another ds to inform class teacher if he is having difficult seeing the board, using a red traffic light. Success - let the teacher know he cannot see or move himself next to the laptop 5 seperate times. Evualation ds has gained in confidence in telling the teacher. Has he or hasnt he meet the target?

Do i need to go into why he hasnt met the target in the SA request, or is simply saying that he hasnt met the target enough for SA?

Should also add similar things have been written for all targets.

To develop fine and gross motor skills and sensory awareness. Ds to explain which moves he is/isnt comfortable with 5 times. Evaluation 'ds has come to enjoy handwriting much more'

Similar for anxiety, ds to show a card 3 times. Evaluation 'cards seemed to have worked havent seen ds' Hmm he hates bloody cards and wont use them, thats why you havent seen him!

'last time he was observed, he wasnt last'. That is laughable as a claim target has been met. School are indulging in such woolly language, no-one would know whether he had progressed or not. However, I would certainly take from that that targets had not been met and school were indulging in a bit of arse-covering. I would definitely quote their attempts to avoid answer the questions verbatim to back up your request for a proper assessment.

Thanks Pink, arse covering is spot on, as at last tribunal they had stated he had met IEP targets, even though the 2 submitted where unevaluated. I then wrote to them after tribunal and asked for the evaluated ones they relied on at Tribunal and that is what i got!

Im trying not to say that school have failed or provided inaccurate info in my request, just providing facts that IEP targets have not been met. I was hoping the arse covering would speak for itself, without me having to point it out? (although i might have to at a later stage, for now i am being nice)

I wrote brief notes on a separate page with my opinions, comments, evidence against etc for each document that was submitted for SA. Dont be afraid. Wite it down!

claw4 · 15/05/2012 11:09

Thanks Lovely, thats the problem there are so many areas of need and so much to cover, it gets very long, very quickly!

My SA request just the headings of areas of need take about 2 pages!

Seen as school are not backing me, i have had to rely on quotes from reports ranging over 2 and half years (about 30) to show that he is experiencing the same difficulties now, as he did then. I have done this as an enclosure on seperate sheets.

It gets very confusing/conflicing/complicated (even for me) how one difficulty rolls into a another etc, so wanted to make sure that i had explained it clearly.

Well its printed off and ready to go, just need to do photocopies, hopefully hand delivered today! wish me luck Smile

I wish you the very best with this and hope that the LA agree to assess your child.

wasuup3000 · 15/05/2012 12:06

I summised this in one of my appeals - may help?

It is clear from the SEN Code of Practice, Chapter 8.13, where the child?s learning difficulties call for ?Daily individual support from a Learning Support Assistant is required? ?The regular involvement of non-educational external agencies is required? that the LA should give strong consideration to formally identifying *name needs in a statement.

claw4 · 15/05/2012 13:51

Thanks Wassup, it is signed, sealed and just delivered, i quoted practically all of the SEN COP part 7 at them.

Thanks, I will save your SEN COP quote in case i need to appeal in 6 weeks time. Just need to write the date down now and then i can have a cuppa Smile

Claw - Good luck. Will follow your 'story' and try to help if and when I can. You sound like you've done all the right things. I understand how it can be overwhelming as there is just so much and most of it is interrelated and confusing and getting to the point of being able to explain it clearly is no easy task.

In reality, and to us, it is a blimmin straighforward case, - but I know that it simply doesn't work like that and being right, and even being obviously right just sometimes isn't enough.

claw4 · 15/05/2012 16:29

Cheers Star, much appreciated.

I tried to write it, as if i knew nothing at all about ds, literally spell it out. Last time i tended to assume that the expert reports would speak for themselves or even that the people involved in deciding would actually read the reports. It was clear last time, that they expected me to do this. So i have done this time!

I could have gone into great detail about WHY ds hasnt met targets, not made progress and backed this up, but that would have made it extremely long and ive held a bit back in case of appeal.

Hopefully i have done enough to get them to agree to assess, without having to appeal, wouldnt that be a nice surprise for once!

Wishing you all the best, claw. It sounds like you have done a very thorough job.

StarshitTerrorise · 15/05/2012 18:03

Claw, I think you're in a stronger situation this time because you KNOW the flaws of the system and you're not caught by expectations and hope that justice exists and that people tell the truth. You're able to 'compensate' to an extent etc.

StarshitTerrorise · 15/05/2012 18:06

Oh, and a vicar in the GPs told Ds to 'get out of my way!'

Lol, tickled my humour actually, especially as nurse saw it and her face was a picture. Clearly though vicar was extremely rude and completely went over Ds' head.

StarshitTerrorise · 15/05/2012 18:06

Oops, wrong thread!

Iceflower · 15/05/2012 21:36

Best of luck.

claw4 · 16/05/2012 07:02

Lol Star! Yes i think so too, im feeling positive Smile

Thanks pink and Ice
