so I need some advice from you lot in case I am over-reacting about this.
Finally won a statement and gave draft copy to HT over 3 weeks ago. Said I was looking forward to receiving a new IEP with 'smart' targets asap (Sencop states this should be done as soon as sm is finalised). Chased up Senco yesterday as ds still having lots of problems and I am was not aware of anything being implemented from the sm. I pointed out that we expected IEP shortly and that we expected implementation of sm urgently so ds can have the increased support. No written response received but answerphone message that stated they had just received the sm yesterday!(Senco obviously unaware that HT has had this) Date set for review meeting in 5 weeks time.Am annoyed that I have been lied to and that funding has commenced but ds does not seem to be receiving the benefit. Wwyd?

I think they can probably weasel out of doing anything until they had their copy of the statement from the LA. After that, the SENCOP is v clear that unless it is a new placement, the IEP etc has to be sorted immediately. Obviously SENCOP isn't law but doesn't reflect well if they disregard it. Just a small thing to check, but DS1's school had to do a Statement Implementation Plan meeting, but this happened well after his statement was issued and his statement and IEP were already in force (well mostly!)

I would send a polite email back to that effect, e.g, there appears to have been a misunderstanding blah blah SENCOP blah blah. Can make a meeting on x dates of first week of term back to discuss IEP.

If school won't budge I would contact the LA tbh, as it is the LA who have their necks on the line with a child not receiving the contents of the statement.

Thanks Polareyes. Regardless of the IEP being completed shouldn't the provision on sm be provided as soon as they get the sm? Was advised that advert for new LSA would get done straight away but no sign of it yet. Then there will have to be interviews etc. so we'll be lucky to get support in place by February. Meanwhile ds is still being punished and missing lesson time/playtime because he is 'rude' to staff.

I couldn't find anything on deadline of receiving provision, only that LA's must arrange provision from the date of the statement. (SENCOP 8:109). May be worth trying IPSEA or SOS!SEN to get their take on it, it seems very unfair for your DS to be punished. Does his sm make reference to his social interaction difficulties in any way? If so SENCOP (again!) 8:116 would be a timely reminder, as despite not having a TA yet, those involved with your DS must have full knowledge of his SENs and if it states they must use clear language blah di blah they would be breaking the sm if not following it.

Also, was any suggestion made for a Specialist Teacher to be involved? I can't begin to describe how helpful I've found DS1's - I am a bit in love tbh! As LA employees they can get a bit "oi school do this now" whilst having a fair amount of influence if emergency funding is needed. My thinking is your DS could benefit from a temp TA whilst they are going through the recruitment process.

8:116 When a statement is made, the LEA should tell the ?responsible person? in a maintained
school ? see paragraph 1:19 ? and the head teacher in all other schools and in early
education settings. They must then ensure that the child?s special educational needs are
made known to all those who will teach them. Schools should ensure that teachers
monitor and informally review the child?s progress during the course of the year. Teachers
should use both the normal curriculum and pastoral monitoring arrangements for all
pupils as well writing IEPs, as appropriate. It is most important that, if a child?s special
educational needs change, a review is held as soon as possible to ensure that the
provision specified in the statement is still appropriate

Thanks again Polar. He does have an LSA at present but they are not getting on, LSA has made comments such as 'grow up' and 'which high school are you going to? If it's ..... they won't put up with your behaviour'. Have told HT that he is not suitable for ds but no-one else available until new one is recruited.
Statement does mention his social difficulties and literal understanding,lack of self-esteem etc..
No mention of specialist teacher but he has no dx at present. Behaviour support have been involved and are meant to be helping with the IEP targets. Seems silly that after all the fighting to get the sm they're not rushing themselves to put support in place. He was even excluded recently before sm was finalised but I feel this could have been avoided really. Thanks for taking the trouble to reply.

telling a child to grow up ffs?!? Sad for your DS that a person who is supposed to support him seems to be doing the opposite.

DX isn't needed for the Specialist Teachers, they are for all children with SEN, though there are ones that are experts(!) in ASD. It was the Ed Psych who referred DS1 to their services, worth a phonecall? I can't go in to the details of why I am such a fan, but can say the 2 we've had (one was preschool) have really gone way beyond what you would reasonably expect them to do.

I am very disillusioned with schools and statements atm so not the right person to offer positive words! I do really hope your school has just gone into holiday mode early and they spring into action in the new year.

Polar - have seen your thread about your problems with school and hope things improve soon. Thanks for your advice I will look into contacting our very helpful EP if things don't get any better in New Year.
