EDCM welcomes new access to Special Educational Needs and Disability Tribunal for parents
From Wednesday 1st September, parents will be allowed to appeal to the Special Educational Needs and Disability Tribunal if their local authority does not amend their child?s SEN statement following a review.
Annual reviews are statutory requirements and local authorities must seek evidence from teachers and parents on the ongoing suitability of the provision outlined in the statement. Previously, even where parents and teachers are in agreement that a statement needs to be amended, the local authority could still refuse to amend the statement with no right to appeal for the parent.
These new rights were introduced through the Children, Schools and Families Act 2010, in response to a recommendation from the ?Lamb Inquiry: Special educational needs and parental confidence? report...
