Am I still in time to appeal?

I received a decision notice from my LA on 31st March. However, the final plan was not issued until last week for a variety of unreasonable excuses.

I want to appeal the plan but I can’t work out if I’m in time or not. Does the two month time limit start from the decision notice date (March) or the plan issue date (May)?

I’ve requested a mediation certificate today.

Do I then have two months from when I receive the mediation certificate to submit the appeal? (July)?

An Education, Health and Care Plan (EHCP) appeal must be received by the SEND Tribunal within two months of the date on your local authority’s decision letter, or within one month of the date on your mediation certificate—whichever date is later

Thank you; does that mean I have until the end of June to appeal if I get the mediation certificate shortly?

As pp said, you will still have time.

If the EHCP was not finalised until last week, go back to the LA to get them to issue the correct decision letter. Sometimes SENDIST refuse to register if the decision letter isn’t correct. Once you have the mediation certificate, SENDIST may accept it with the old decision letter, but I would get on the case of chasing the LA just in case SENDIST doesn’t.
