SEN school transport law with EHCP but under 2 miles

DS starts sen school in September, drive is exactly 2 miles and there's two walking routes one is 1.6 miles and one is 1.9 miles (the shorter one is a cycle lane for a part of it and a river that may flood that choice depending on how rainy it gets, the longer is all pavemented nicely with traffic lights so there's no question of safety for me walking).

He can't really walk that distance and I was going to use his disability buggy for all the school runs, (can't drive due to my own DCD making me quite the death trap in a car) but had a meeting with school today and they said that maybe we might actually get transport as an option despite not quite hitting the 2 miles.

My question is legally what the odds on a case that's such a borderline situation are school right that it's worth a try? And if that's the case I presume it's the cheapest option if so would that be they issue DS with a bus pass and I d pay for the bus rather than him being given a shared taxi or would they insist on DH as the driver having the small transport grant? (He works full time and I m not currently, I know that doesn't come into it).

The statutory walking distance isn’t relevant to transport applications made for DC who can’t reasonably be expected to walk to school because of their SEN.

The method of transport depends on the child’s needs and individual circumstances, but they can’t force parents to accept mileage/personal transport budget.
