Still no school listed on ehcp

My son is due to start y7 in September. Currently in a maintained SEN primary.

We have chosen an independent SEN school - who can meet need and have offered a place.
The LA are consulting other schools because of the cost of the one we have chosen.
Up to now they had one offer from a maintained school that has since said they are full. The other schools have been a ‘negative’.
They are chasing 2 more consultations which should’ve responded last week.

I am getting the feeling this is a delay tactic after today’s conversation. I am running out (have ran out?) of time to get a tribunal date, and wondering what I should do next as panicking.

Please advise! 🙏

Has the LA actually finalised the phase transfer EHCP yet like they should have done? If so, have you submitted an appeal yet? If not, you need to do that ASAP.

Is the independent school wholly independent or section 41 independent?

On its own being ‘full’ doesn’t prevent a school being named, so the LA could still name the maintained school who say they are ‘full’.

It is a section 41 school. And yes they sent the ehcp on the 15/2 deadline and said they would add the school later - just ‘specialist’ was named.
I have the right to appeal but they gave me the impression initially it wouldn’t take long - had to go to panel due to the school cost.
I will get on with it tomorrow 🥲

Definitely appeal ASAP. Appeal B&F as well as I.

For a section 41 school, your preference must be named unless:
-The setting is unsuitable for the age, ability, aptitude or special educational needs (“SEN”) of the child or young person; or
-The attendance of the child or young person would be incompatible with the provision of efficient education for others; or
-The attendance of the child or young person would be incompatible with the efficient use of resources.

The LA may concede once you appeal. Equally don’t be surprised if they propose a different school that isn’t your preference (and potentially isn’t appropriate).
