Do I have to declare an EHCP to a private school?

We have a EHCP which is total rubbish and we need to figure out a way to get it removed.

Just curious if we need to declare we have one if we choose a private school.

The LA can only legally cease to maintain an EHCP if it is no longer legally responsible for DC or it is no longer necessary (in the legal sense) to maintain an EHCP. Making your own arrangements for education would not meet the bar for either reason.

If the EHCP is poor, have you appealed?

Lots of independent schools require parents to declare any SEN or suspected SEN during the application. Some will revoke the place if they find out parents have lied. Schools will find out DC has an EHCP even if you don’t disclose.

Just to reiterate OP, details of any SEN needs would almost certainly be asked about any schools application process with possible declaration of an EHCP at that point. The LA I'm guessing would also need to be informed of the school that your child attends and will then liaise with the school about Annual Reviews etc. It might be possible to make a case to the LA with your Senco that the EHCP is no longer required, if that is indeed the case and in the child's best interest, am unsure. It probably doesn't often happen as most people are desperate for them but would also recommend Appealing as often the first version EHCP can be poor.
