Am i being a petulant twat or is the joke on me?

Any advice gratefully received. I just sent this email to our legal rep re my daughters current educational situation. DD is 11.

I have had no response to sending the receipts for education provided so far in. A guy called X called me from IPS last week and said they were in the process of taking on commissioning and had contacted X, the tutor. that was last week. They haven't.

X from IPS was unimpressive, he didn't know anything about DD, I asked him if in practice section 19 was not legally binding and he just mumbled.

I've chased 3 times now. DH and i are still paying for her full education in the interim despite her being disabled, signed off school, still registered at school so school still receiving full funding plus pupil premium and she has a finalised EHCP, yet she has no educational support or funding and we are providing it all, 5 months after she left school.

I think they will continue to fob me off for as long as they can because they know the onus is on me to go forward with an expensive JR which they know parents will be reluctant to do.

If i had time and could be bothered i would write to my MP.

Thank god we have the means to walk away......

Provision under s19 of the Education Act 1996 isn’t optional for LAs. Despite what many think.

JR doesn’t need to be expensive. Have you looked at SOSSEN for a pre-action letter? The PAP Project is free. Often a pre-action letter will work. If it doesn’t work, JR proceedings themselves would be in DD’s needs and she can be eligible for legal aid herself. Your ‘legal rep’ should be telling you this.

thank you i have diarised contacting Sossen to find out about using them as a service to get a pre action letter done. The LA are just going to continue to ignore me. The SEN Paralegal we are using seems to be very nice but very part time and quite flakey so i think that Sossen is probably the way forward now.

If the paralegal can’t even give you simple, accurate information, they are not worth your money.

Alongside s19 provision, you say DD has a finalised EHCP. Did you appeal the EHCP? The LA must also provide anything detailed, specified and quantified in F. You should email the Director of Children’s Services about this too. If necessary it can also be enforced via JR. However, if the wording is woolly and vague, it cannot be enforced.
