Appeal deadline tomorrow and school undermines it completely

Our appeal deadline against a refusal to assess is tomorrow and I've just seen the emails between the primary school and the LA in which the school SENDCo has literally said: Yes, we are meeting DC's needs with what we have in place.

DC has an ASD diagnosis and and ADHD assessment next month. He has been falling behind and really struggling. SENDCo to my face ensured me she was going to take care of everything. I could she her work was completely shoddy but this is pretty rubbish, right?

Is there anything we can say as a final statement to SENDIST before noon on Wednesday to counter the damage from the school?

Try not to worry, this isn’t unusual. I presume you have other evidence? If so, let that do the talking. If you have evidence of the school saying they can’t meet DS’s needs in writing that would be good to point to, but if you haven’t don’t worry it isn’t essential.

Thank you. I managed to speak to the HT this morning and she has written a brief statement to the LA asking them to reconsider their refusal to assess and giving some reasons. Hopefully that will help.

You are welcome. Do you have a copy of the statement you can use as evidence? If not, ask to be copied in.

Yes, she sent it to me and the LA. The LA did not submit it today as final evidence (but I did with an additional parental statement), and the deadline has now passed. Now we wait.
