1st EHCP Review - what to expect

1st EHCP review is coming up and I’m anxious. It feels like we’ve only just got through the stress of getting it awarded. With school transition to secondary etc hardly any of the EHCP provisions have bee.n properly implemented.

can reviews remove support that’s in an EHCP? I’m thinking school (mainstream) May minimise issues - in part because they haven’t had time to see them yet.

The provision in the EHCP should be being provided. If the provision in F isn’t being provided and the wording is detailed, specified and quantified it can be enforced. Remind the school it isn’t optional. Also, email the Director of Children’s Services because it is the LA who is ultimately responsible for ensuring the provision in EHCPs is provided. If that doesn’t work, email the LA again threatening judicial review. Then if that fails, contact SOSSEN for help with a pre-action letter. However, if the wording is vague and woolly e.g. “access to”, “would benefit from”, “opportunities to”, “such as”, “regular”… it isn’t enforceable and you should use the AR to try to tighten it up.

EHCPs can be amended, including removing provision, as part of the AR, but the LA shouldn’t do that just because. They shouldn’t remove it if it is still reasonably required.
