How long should it take for EHCP to be updated by SENDO after AR?

Annual Review carried out 3rd November, my son is now at transition phase (year 9), and lots of places have asked for the EHCP, only the SENDO didn’t attend the AR, and when I requested a copy from school and LA they gave me 2020’s copy and it hasn’t been updated since then!

I have never needed it, son is staying where he is, but now the age has come I am
looking at transition into adult services so his EHCP is what everyone wants to see.

Sent SENDO an email offering to help as a lot has changed since 2020, , she only works Tuesday and Wednesday (i kid you not), she sent me an email back saying when she’s “assigned” it she will be in contact.

I have replied with how long will that take? And zero back.

Can I legally force her hand with a timeframe - surely there’s a SLA in place for these? I can only find on the net that to create an EHCP it’s 20 weeks end to end.

Here are the timescales. The LA should have informed you whether they were going to amend or not within 4 weeks and if they were sent the draft. Then they should finalise within a further 8 weeks.

Email the Director of Children’s Services informing them they are in breach of their statutory duty and if it is not remedied ASAP you will be forced to begin judicial review proceedings.

As above. The SENCo doesn't write or amend EHCPs, it's the local authority.

OP said SENDO, not SENCO. The SENDO works for the LA.

X-post. You are more likely, although not certain, to get action if you email the Director of Children’s Services.

After Ds's first AR we sent this letter to the Director of Children's Services and got the paperwork sent to us within 48hrs. Four months after we should have got it.
Probably going to have to do it again. Ds's AR was the 13th September and we've had nothing....it's like groundhog day at our LA....

The ability to make parents feel like they should be grateful is a prerequisite for the job, I think.
