What happens if a school refuses to carry out ehcp?

My child starts a new school in September and the school named have said they will not/cannot carry out several parts of section f. I am waiting for a meeting with the LA to discuss this but can anyone tell me what happens if a school refuses to carry out an ehcp? Will my child be forced to find another school?

Provision specified and quantified in F must be provided. If provision isn’t provided and section F is specified and quantified you should email the Director of Children’s Services informing them they are ultimately responsible for ensuring the provision in F is provided, and if the provision continues to not be provided you will begin Judicial Review proceedings. Also email the headteacher informing them section F is legally required to be delivered and if they do not provide the support they leave themselves open to a Disability Discrimination claim &/or being named in any Judicial Review proceedings.

Unfortunately, if section F is woolly and vague with wording such as “access to”, “would benefit from”, “regularly”, “.when required”, “opportunities for” etc. it cannot be enforced and you need to ask for an early review to make it specified and quantified.

As to whether you will be forced to look for another school, is the school wholly independent?
